notice. Normally, a new fee letter will be drafted for the RFE notice

I explained to you earlier over the phone, I went to hospital emergency
room because of my constant high fever for weeks during that period. I
also timely requested an extension to reply your RFE notice with the
Immigration based on my medical situation. Based on the unforeseeable
medical emergency, the Immigration normally will grant the extension
request. All this information has been fully disclosed to you.
I also noticed that you posted many articles related to me in Chinese
communities, including mitbbs.com, Emory newsgroup and etc. You clearly
knew that the delay was caused by my medical situation. Unfortunately,
you intentionally did not disclose my medical situation in any of your
posts. In fact, you put me in a false light that I delayed to notify you
of the RFE notice with gross negligence. I stand for your right of
freedom of speech. However, it does not mean that you are free to
infringe my rights. I am a licensed attorney and the fact that you put
me in the false light caused me a great damage to my practice.
The conflicts of interests between you and me now prevent me from
representing you in your immigration matters in a full ability. I would
like to have a phone conference with you in person to discuss your
matters. Please email me directly to schedule an appointment in this
week. Your prompt reply is greatly appreciated.

蹦乱跳的，不像有病的。即使有病，也不能因为你的生病而耽误别人的事情。试问公司
的经理病了，该公司就必须关门？胡锦涛病了，中国就不过了？即使死了你的公司也要
照常运转。再退一万步讲，即使你病了，公司不转了，那么由于你的原因引起的损失，
也是你的错误，你也应该赔偿你的客户。在美国混了那么久这个不懂？这个律师不仅仅
水品差，脑子也不好使，找借口都能让非专业人士挑出破绽。真是让人笑破大牙的律师

kind of low attorneys just believe they could fool around without paying any
price. That's not a fair game rule. For them, it's all about their bloated
greed for money. But for us, it's about basic living right in this country,
the overwhelming pain, burden and responsibility for our families.
Even if the initial contract didn't cover RFE fee, that in no way should be
an excuse for delaying the notice, which was a huge damage to you and your
family. If she is wise enough, she should admit her mistake, apologize for
that and try compensate/settle it with you financially.

谢谢你的信任。
说来话长，本来没有想提过的。不过这里是工作版，也许会有很多人会有和我同样的经
历。我不是说中国人的所或者公司不好，但希望大家从我的经验教训里学到些东西。
我当时毕业的时候在某中国人的公司工作，我是美国的硕士毕业。我用OPT工作一段时
间后，公司决定帮我申请H-1B，当时雇主说的是，拿到H-1B后，我再为公司工作一年。
后来H-1B被批准了，雇主也一直都没有给我H-1B的批准书，我只好主动找雇主要。然后
雇主很突然的拿出一个合同，要我签字后才能给我H-1B批准书。中国公司的工资自然是
低的没有办法说。可是更糟糕的是合同里突然把工作的年限延长到两年，并且写着如果
我提前走人，需要交给公司一笔天文数字的罚金。当时我的OPT已经结束，已经来不及
另外找工作了，所以没有选择的，我签了这个合同。
那个时候刚好赶上劳工纸的改革，我从最初的RIR做到后来的PERM。很多人可能都没有
办法相信，我经常是同一时期，同时并行处理40-50个劳工纸案件。我每天都加班到很
晚，完全没有私人生活，而且工资也不见什么增幅。等我用H-1B工作到一年之后，已经
没有什么可学的，而且人因为工作的强度，也很疲劳，所以我决定辞职，并且很快也和
雇主说了。可是我和大部分客户的感情都不错，我不希望因为我的辞职而耽搁他们的案
件申请，所以答应雇主继续干两个月，把客户的所有工作都交接好。那个时候，雇主对
我也客客气气的，我也以为大家好聚好散。
在我工作的最后一天，雇主的夫人来了。在我和她做完所有的交接工作后，她突然态度
急转直下。第一是要求我赔偿天文数字的赔偿金；第二是告知我会通知移民局马上取消
我的H-1B身份；第三是要求我和这个公司签署一个反竞争协议，要求我不能和任何客户
有任何联系，否则就不发我该得的那个月工资；随后她跟随我到我的办公桌，在她的监
视下要求我立即打包走人。我没有想到事情发展到这样一个状态。因为我的办公桌面上
，有一个文件夹是放我的私人照片，我于是当着她的面永久删除了。于是她开始对着我
尖叫，说我删除公司文件。我告诉她，我删除的只是个人照片，如果她愿意的话，可以
用修复软件看一下就知道了。但是她不依不饶，当着所有公司人的面，侮辱我。那一天
我一路哭着回家，大概一辈子也没这么寒心过，不知道为什么我的善意换来的是别人的
侮辱。
还有上帝总是在关上一扇门的时候，开启另一扇门。我再听到之前雇主要取消我的H-1
后，马上开始了找工作。很幸运，我被一家在行业里有一定知名度的美国公司给录用了
，并在三天之内帮我提交了新的H-1B transfer，我几乎是连滚带爬的跑去了这家美国
公司工作，总算把我的身份给保住了。
之前的中国公司还欠着我一个月的工资，考虑再三，我决定我还是应该要回来。于是我
做了很多法律检索，咨询了很多第二家美国公司律师的意见。美国的移民法明文规定H-
1B雇主不能对H-1b员工设定工作年限，更不能因为H-1把员工辞职而要求罚金。工资是
我应得的，哪里有离开公司的时候，我还要被迫签那个反竞争协议的道理。谢天谢地，
被我找到了这些法律依据后，我写了一封正式的通知函，引用所有法律条文，并通知之
前的雇主，我不会付赔偿金，也不会签那个反竞争合同，并且我要求我的应得工资。去
中国公司之前，我很害怕。于是我只好拉了一个高大的中国男H-1b陪着我，以防出现任
何类似意外。到了中国公司后，我把书面通知承上，并告知原雇主我的态度。Anyway,
中间还是出现了一些波折，但最后总算让我拿到了那点薄薄的工资。走出中国公司之后
，我抱住那个中国男H-1b大哭了一场。
后来公司的一个律师告诉我，原来的雇主给所有的员工发了一封电子邮件，大概就是说
我偷公司的资
料。不过那个律师对我说，他相信我，并且告诉我不要太在意雇主这么mean。当然，几
个月后，这个
律师也辞职了，结果他被整的比我还惨。哈哈，后来我们两个还一起喝咖啡，在一起诉
苦。不过，总
算这一切结束了，我也算步入了正轨，在新的公司里我开始了学习的过程。并且我也再
没收到账单要
求我付那个天文数字的赔偿金额。记得那句话，那些打不倒你的东西，只会让你变得更
坚强。

请大家不要对号入座。重要的是大家能从我的失败经验里有所感悟或者收获。
当然不是。。。 我的朋友认识她的前任老板。 听说拿了客户资料和老板娘掐了架后出
来的。。 现在在这里给新主子作广告来了。 对别人善意的提醒一口一个律师函的吓人
， 是在看不惯！

看来一切都顺利.恶梦来了.PERM是雇主支持的,我就不好太过问.以免雇主和律师两边都
不高兴.过了一段时间我给LUCＹＬＵ发个信问问进展，这个ＢＩＴＣＨ再也不回信了．
又过了一段时间，发个信问问，也不回信．就这么反复发信几次，都没反应．最后老板
发信去问，也不回信，打电话也不接，最后我急了，找到她公司老板ＫＵＣＫ，还得她
负责，前台说她在上班，就是不接电话．就这样拖了很长时间．ＫＵＣＫ公司另外一个
主管给我发信说这个ＢＩＴＣＨ已经被解雇了．他来负责．我狠狠地发信抱怨了一把，
整整几个月没反应，ＬＣＡ都过期了，他说没办法，这个ＢＩＴＣＨ走时也干了很多对
公司不利的缺德事．我想其他申请人恐怕也有同样的遭遇．没办法只有重新申请ＬＣＡ
，新规则出来了，这又是大半年的等待．等到批准了，我也没信心了．干脆让公司支持
我办ＥＢ１Ｂ，最后也批了．我想提醒大家千万别在这个ＢＩＴＣＨ那办ＧＣ，她的人
品太差了，谢正权和ＫＵＣＫ赶她走是有原因的．
