notified by mail when a decision is made, or if the office needs something
from you. If you move while this case is pending, please use our Change of
Address online tool to update your case with your new address or contact our
customer service center at 1-800-375-5283.
我的状态（decision）情况如下：
On September 3, 2014, we mailed you a denial decision notice for this case
I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. The
notice explains why the denial decision was made and the options that may be
available to you. If you have not received this notice within 15 days of

老公父亲的 I-864,以及Form 1040V, 1040A, W2, SSA-1099
老公的I-864A 以及1040EZ，W2
我5日接到USCIS的信写得非常清楚，说：
you have failed to establish your eligibility for the benefit sought,
accordingly the application must be ,and hereby is, denied. and any pending
ancilliary Application for EAD, I 131 , I 485 ALSO DENIED.
there is no appeal to this Decision, ~~~~~
if you desire to file a motion, you must do so on I-290B

综上所述， 是不是说我先生应该file I864, instead of I 864a(当时这个表格还是打
客服电话说的，所以才缴了I864A)

很快会拿到绿卡，但是你可能会有问题；反之，你父母在美国，你肯定没有问题，但是
你丈夫可能会比较麻烦。所以你485被拒不仅仅是税表的问题，这方面请大牛帮着支招

先生和公公来担保我亲属移民，申请绿卡。
但是他们都比较忙， 把这件事看得太简单，匆匆填表就让我file，可我英文不够好，
理解上有偏差，造成了今天的被动。他们还不要我请律师，说这么简单的事情，请什么
律师，律师的charge太贵也是原因。
我现在什么表格都没问题，看来就出来I864上边了，现在基本清楚，先生，公公都应该
填写I 864, 他们没有联合报税，各自报税的，是这样么？
他们所有近三年的税务上的report都交给我了，我全部拿上去就可以了吧。但是例如

刚才替先生把他的I 864填写了一遍，感觉好复杂。
有几点疑问：
1，先生，和公公，各给我填写一份I 864，对么？
2，如果我婚前有一些存款，是否我有必要将我的CD 数目写在 I 864上，先生开始都为
空，我一直不知道有这个选项。
3，I 864A 是先生、公公以外的担保人填写的， 若他们二人收入足够了，就不需要找
其他亲戚填写 I 864A了，对么？
4， 以上表格的签字没有特殊的公证要求？
5，Sponsor's householder size, 就写我一个人，还是包括他们自己，都要写2个人？
例如先生的I864, sponsor 一个人，加上自己一个人，总数2个人？
6， 如果我重新提交I 485的话， 是否$1070需要重新缴纳？ 若如此，也太黑了吧。

and check the appropriate category on I-864 part 1 (husband checks 1a,
father in law checks 1d). if your 公公 have enough income (>125% FPL after
including all his household members + you), it should be no problem.
Otherwise, USCIS must deny your application.
No I-864A is needed here, because you don't have income and you are not on
the same tax return with your husband.
There is no 结婚一年以上才能申请转换身份 requirement. if when I-485 approval
the marriage is < 2 years old, you will get condition permanent residency

所以，就有了Sep.3的notice of Decision， DENIED

我仍然可以继续整理一套全部的I485资料，包括照片，申请费1070，过去交上去的出生

dependents' income on the 1040 to meet the requirement, it will be more
complicated and I-864A plus additional forms are needed. Please fully
understand the forms and their instructions before you send them out.

整个早上，我都在研究I 864的instruction， 发现确实填错了一些：例如
part 3， information on the immigrants you are sponsoring. 我已经在part2
principal immigrant出现，就不要再填写了，只要打钩yes 就可以。
还有仔细的检查了support documents，发现公公的会计师偷工减料， 只给我了2013年
的所有表格，W2还只是一个summary，1099 social security benefit 只是一个简单的
statement， 只有1040A是完全的。
问题：
1，我需要拿到w2，1040a，1099，三年的report，对么？ W2必须是完整的，不能只是
一个summary，也需要三年的w-2明细。
2，所有的support documents，会计师准备的，需要谁签字么？例如公公，或者他的会
计师？

这次我太紧张了，实际上，楼上的大牛们都把我的问题说的很清楚了，但我就是怕怕的
，怕再退，趁着老公不在身边，打算找个律师算了，。
他看了一下，说，你要重新file I-485， 而且重新交纳1070， 因为你案子被deny了！
让你交的表格你交成了I864A， 所以你被deny了，没办法 RE-OPEN。

通过本论坛，我找到了一位在家附近开律师楼的朋友，约了一个小时的付费服务，他帮
我review了一下所有材料。
如下结论：
1， 肯定不能file I-290B
2, 重新file I-485， 再缴纳申请费1070（包括打指模，其实我已经打过了指模）
3， 补I-485 缺少的那个I 864， 不用缴费。
2，3，之间，他说法律没有明确规定，要我自己选择，到底重新file缴费，还是只是补
交上次的材料。
按照移民局给我的notice of decision，他罗列了我的deny理由，第一次要求的材料是
XXX，可我交上来的是XXX，fail to submit XXX，其实就是我先生的I 864，但是明确
告诉了我be denied。摘录要素如下：
you have failed to establish your eligibility for the benefit sought ,
accordingly, the application must be, and hereby is, denied.
uscis, has determined that any pending I 865, 131 也都denied了。
there is no appeal to this decision~~~
if you desire to file a motion ,you must do so on Form 1-290B within 30 days.
我感到非常崩溃，我自己选择，怎么选择呢？
