Re: Response to Request for Evidence
Dear Sir/Madam:
We filed our form I-485, Application to Register Permanent Residence or
Adjust Status together with form I-130, Petition for Alien Relative in
August 2013 and the petition is based on LPR NOT U.S. citizen. We answered #
14 (for LPR) of Part B in form I-130 instead of #13 (for USC), and the
preference classification on both I-130 and I-485 receipts is "203 A2A INA
SPOUSE OF LPR", which indicates that the petition is based on LPR as well.
We have enclosed a copy of petitioner’s green card (front and back) and
copy of the receipts for your reference.
The following instructions and documents explain why we could concurrently
file form I-485 with form I-130:
1. The Visa Bulletin for August 2013 shows that the cut-off date of F2A (
Spouses and Children of Permanent Residents) for China-mainland born is "C".
2. Section "When Visa Numbers Are Available" of document "Visa Availability
& Priority Dates" from USCIS website: Visas are available when the chart
designation is “C” for current. This means that immigrant visa numbers are
available for all qualified overseas applicants and adjustment applicants
in that particular visa preference category and country of birth.
3. Section "Visa Availability and Concurrent Filing" of document "Concurrent
Filing" from USCIS website: A petition and application may be filed
concurrently when there is a visa number immediately available at the time
of filing.
4. Part 1 and in particular sub part B on "Who May File Form I-485" of
Instructions for I-485: You are filing this application with a completed
relative petition, special immigrant juvenile petition, or special immigrant
military petition which, if approved, would make an immigrant visa number
immediately available to you. A completed relative petition is the completed
I-130 for us.
The documents mentioned above are enclosed for your reference. Please

我还没有回复，因为LG的公民申请已经面试过了，可能过1，2 个月就宣誓入籍了，在
犹豫着是现在回复这个RFE， 还是干脆等2个月。。。
