USCIS has instituted a stricter standard in adjudicating EB.1 - Outstanding
Researcher cases. Satisfaction of the minimum regulatory requirement (2 out
of the 6 requirements) is no longer the threshold for eligibility. Not
only do you have to, at a minimum, satisfy 2 of the 6 eligibility criteria,
but you must also firmly establish that you are internationally recognized
as an outstanding researcher in the field. This second criteria is very
difficult to establish. First, they will look at how well you satisfied the
initial regulatory (6 eligibility) criteria - in which case, your case is
not very strong. Then, you would need to provide strong objective evidence
that you have been recognized internationally as an outstanding researcher
in your field. Though you have 65 non-self citations, this is not strong
evidence of your international recognition as an outstanding researcher.
From our understanding, you have the following achievements relevant to the
OR analysis:
No Major Awards or Prizes;
No notable memberships in associations requiring outstanding achievements
No published works about Peng Liu's research; - 65 Citations/references to
Peng's work;
2 time Reviewer for Journal
1 Invention Disclosure to be submitted;
10 Published Articles (and 2 Conference Presentations)
At this time, we cannot advise that you have a strong case for EB.1/OR
