都在pending。 因为之前LD护照快过期，回国后回来海关i94时间给到了护照过期日，
而不是H4 expiration。现在我renew h1-b 公司律师说在新政策下必须保持i94的有效
性，否则就会给NTA。我的理解是已经交了485就是AOS, 只要不离开美国，就算i94过期
了也没事。下面贴上律师的回复， 请大神解读
Due to recent changes in USCIS’s policies you cannot let her I-94 run out.
In past years they have been more lenient with the dates but that is no
longer the case. If an I-94 expires the individual will be issued a Notice
to Appear (NTA) and put into removal proceedings (please see attachment).
As it stands, you have two options:
Your wife leaves the U.S. before her I-94 expires. She stays abroad
until the H-1B extension is approved and then she applies for an H-4 visa at
the consulate abroad.
We file the H-1B and H-4 at the same time with premium processing.
I don’t want to force your hand into using our services or anything like
that, but it is absolutely necessary to keep her in status in the current

V. Aliens Not Lawfully Present in the United States or Subject to Other
Grounds of Removability
USCIS will issue an NTA where, upon issuance of an unfavorable decision on
an application,
petition, or benefit request, the alien is not lawfully present in the
United States.
485批了还好，被拒了就会发NTA,等着上庭或者file voluntary departure, 估计会很
麻烦。但是假如我绿卡批了，LD的H4就自动消失了，还不是只能等485? | l*******n
