In response to CONFIRMATION OF JOB OFFER OR REQUEST TO PORT in the letter, I
would like to clarify the fact that my I-40 was approved in the case of a
National Interest Waiver Alien of Exceptional Ability (EB2-NIW), requesting
that the labor certification requirement would be waived for the sake of the
“national interest of the United States;” thus, allowing an applicant to
apply for an NIW immigration petition through self-petition, without a
sponsoring employer.
Please see the attached document regarding my approved 1-40 form.(Exhibit 1).
In the light of the instruction of I-485 Supplement J, Confirmation of Bona
Fide Job Offer or Request for Job Portability Under INA Section 204(j) on
the page 1,
“ NOTE: Individuals seeking or granted a National Interest Waiver of the
job offer requirement and individuals seeking or granted classification as
an alien of extraordinary ability under INA section 203(b)(1)(A) do not need
to file Supplement J. Because these employment-based immigrant visa
categories are not tied to a specific job offer, individuals seeking or
granted classification as an alien of extraordinary ability or seeking or
granted a National Interest Waiver of the job offer requirement do not have
to file Supplement J when filing Form I-485 or to request job portability
under INA section 204(j). “ , I do not need to file Supplement J, as a
beneficiary of NIW. Please see the attachment document regarding the
instruction of I-485 Supplement J.
To verify my current job, I include the job offer and employment
verification letter from my current employer
