今天收到律师的信说绿卡approve了,但是律师发了一封信强调了几点:其中有三点我
想请教大家
(1) 我需要继续为这个公司工作多久,这样以后入籍没有麻烦?律师没有明确写
多久,但是说long term。
我在这个公司目前的工资比prevailing wage低不少,而且是工作35个小时,这样合法
吗?拿到绿卡公司需要realize 那个prevailing wage吗?
律师的信: You are authorized to be employed full-time. It is extremely
important that you continue to work as a full-time (at least 35 hours per
week) XXX for XXX for as long as the firm needs you. If you ever decide to
become a United States citizen, the USCIS may very well ask for proof of the
length of time, after you became a permanent resident, that you continued
in the work you were sponsored to perform.
(2)律师说tax return的时候只能是resident alien,我可是我一直都是用的1040表
格(来美五年之后),这个有矛盾之处吗?我不记得1040里面会问是否是alien了。
律师的信: You are required to maintain your residence in the United States
and to pay taxes each year to the United States Internal Revenue Service on
your world-wide income. As a permanent resident, you MUST file all of your
income tax returns as a “resident alien”. Your failure to abide by these
requirements may result in having the USCIS deem that you have abandoned
your permanent residence, and may result in your losing your permanent
resident status.
(3)律师说要重新申请SSN,大家都这么做了吗?
律师的信: You should now file for a new Social Security card. Your Social
Security number will remain unchanged; however, the new card will not have
any limitations on it.

(1)第一个不知道
(2)第二个resident alien用的表格就是1040呀,是对的呀。
(3)需要去SSN部门更新一下SSN信息,但是号码是一样的

第二个嘛,1040表本来就分1040还是1040NR这种,看你用的是哪种
第三个问题,确定得去换,因为以前的SSN有一行工作限制,现在是无限制了。

SSN不多说了换了就可以;
报税也不是问题,你只要每年都报就可以,税务局有记录; 至于你报得是对是错, 税务局
裁定, 和移民局无关;
重点就是第一个, 连EAD的180天都能换工作,绿卡不能换? 律师为什么要这么说?
你能否把律师的信都贴上来,因为只贴一段容易断章取义, 要看看他整体是怎么说的.

You are now entitled to all of the rights and privileges, and are now
subject to all of the obligations, of permanent resident status. Some of
these are listed below:
1. Any time you move from one address to another, you must give notice of
the change of address to the USCIS within 10 days of the move. This is done
using USCIS Form AR-11, which can be downloaded from the Internet, or it
can be done online, at the following website: http://www.uscis.gov/ar-11. It is only in becoming a U.S. citizen that you will be relieved of this responsibility.
2. You are authorized to be employed full-time. It is extremely important
that you continue to work as a full-time (at least 35 hours per week) Water
Resource Engineer for HGL for as long as the firm needs you. If you ever
decide to become a United States citizen, the USCIS may very well ask for
proof of the length of time, after you became a permanent resident, that you
continued in the work you were sponsored to perform.
3. If you travel outside the United States and stay outside the United
States for more than 6 months, you may encounter difficulties with the
immigration officers at the United States airport upon your return. Staying
outside the United States for more than 6 months can also create
difficulties for you if you ever decide to apply for United States
citizenship. Therefore, if you plan to be outside the United States for
more than 6 months, it will be advisable for you first to obtain a special
re-entry permit from the USCIS.
4. Please note that if you eventually should decide to become a U.S.
citizen, you will have to list exact dates for all of the trips that you
take outside the U.S. 5 years prior to the time you are completing the
naturalization applications. Under the circumstances, it will be extremely
helpful if you can keep a log of each and every trip that you make as a
permanent resident.
5. From the USCIS Notice of Approval, it would appear that you became a
permanent resident on April 15, 2016. You will be eligible to file your N-
400 naturalization applications (to become a U.S. citizen) as of 01/15/2021,
which is 90 days prior to your 5-year anniversary as a permanent resident.
When you receive your Permanent Resident Card, you will be able to confirm
the exact date by looking at the card; the adjustment date should be written
on the front of the card, next to the words "Resident since: ... "
6. If you choose not to become a U.S. citizen, you must make note of the
fact that your Permanent Resident Card will expire in 10 years (i.e., even
though the permanent resident status continues, the document evidencing the
status expire). This means that you will have to request a new card at the
end of this 10-year period.
7. You are required to maintain your residence in the United States and to
pay taxes each year to the United States Internal Revenue Service on your

requirements may result in having the USCIS deem that you have abandoned

8. If you should eventually accept employment in some other country, or if
you should decide to return to China for an extremely extended stay, this
could have adverse consequences for your green card.
9. You should now file for a new Social Security card. Your Social
Security number will remain unchanged; however, the new card will not have
any limitations on it.
Please be advised that under current immigration laws, the act of making a
donation to one of a variety of organizations, including donations and/or
organizations which might appear to be strictly humanitarian in nature, can
be deemed to be a terrorist act. Before making any donation, please check
on the reliability and bona fides of the organization to which you intend to
make any kind of donation.

私下请问一下,是直接去SSN office去一下,带着材料,就跟换驾照一样,去换一下?

税法上只有resident和non-resident,绿卡、公民和H1B的差异只是国外账户/收入是义
务,H1B的时候不是义务而已

拿到绿卡换工作这个问题我原来做过一些研究,结论是马上换未必会有麻烦,但是等六
个月最保险。因为绿卡是基于future employment,就是说你交I485的时候,应该是
genuinely intended to work for the sponsoring employer。但是因为是intention,
所以你开始真心实意地想为他工作,后来改变了想法,也是人之常情。移民局以前有
过所谓0-3-6的原则判例,就是说拿到绿卡等0个月换工作,就是马上换工作,你需要证
明当初交485真的是有good intention;等3个月换,那就是快了点,但是也需要解释一
下;等6个月,基本就没啥问题了,因为一个正常人在6个月内改变intention也是正常
的。
我认为你的大问题是拿到绿卡后工资没有达到PERM上的工资,这个东西不像intention
是比较虚的东西,工资是个数字,没有达到就是没有达到,没啥可解释的。我觉得你应
该要求公司给你涨工资。
