Unfortunately, the DOL denied the PERM because the advertisement that was
posted on the State Workforce (SWA) website included the language DOE (
Dependent on Experience) for the salary requirement. It is our
understanding that DOE is auto-filled if you choose not to identify a
particular wage on the SWA posting, which means it is a systematic issue.
In any event, this has been a recent issue with the DOL and other
practitioners are seeing similar denials. From our vantage point, this
denial was in error and we feel strongly that we should be able to get this
denial overturned.
说实话不太信任公司合作的律师，感觉他们没什么经验，但是没办法没得选。现在请版
上明白的朋友帮忙看一下，有没有经历过同样问题的朋友，或者认识的人有同样问题的
说说，这个翻转可能性大吗？
目前H1B第四年马上开始（新的h1b已批，10月生效）当时perm被audit就有考虑过一旦
denied就换工作，也挺想换
的。能问一下知道的人，appeal如果九月初file大概什么时候会有结果？ |

知道结果。如果还不过，不准备提交appeal了。

perm过了后最好140加个急，以防耽误更多时间。bless

我的第一个perm就deny了2010年6月的，audit到13年在deny之后做的appeal。至今没有
消息，在网站上查前面还有700多个case~2014年7月又重新办里的perm。2015年初就批
准了，140做的加急，现在也批准了。现在正在办理H1B，6年后的延期.
所以我建议还是再申请个perm吧。之前deny的那个想要appeal，没有3年不会有结果的

学校律师也说，appeal的话，要等个几年，还是重新perm或者用别的办法吧 |
