relink的事，律师说要重新file 140，amend回eb2。当然也提了可以直接relink，但是
说没有任何法律依据，完全看rp。稍微考古了一下，只有一个帖子说amendment也可以
直接relink。这个怎么解？
附律师的回信：
There are currently 3 options for proceeding at this time:
1. File an I-140 amendment back to the EB2 category. While we can file a new
I-140 requesting the classification be changed back to EB2, there is no
guarantee it will be accepted by USCIS. When we refile the I-140 requesting
the new classification, we will also request that it be linked to your
pending I-485 application. There is no need to refile the I-485 application.
Once the I-140 is adjudicated and approved, USCIS would start to adjudicate
your I-485 pursuant to its current processing times.
2. Send notification to USCIS regarding your situation and request their
discretion in adjudicating the AOS based on the original I-140 approval in
the EB2 category. Technically, there is no legal authority for this request
so it will be at the Service's discretion to grant this and move forward
with the adjudication of the AOS application. There will likely be no formal
acknowledgement by USCIS of acceptance or denial of this request and we
will have to wait to see if the green card is approved.
3. Do not take any action and remain in the EB3 category. |
