Comments on question #2 under I. Streamlining the Legal Immigration System:
The "administrative process" for H1B visa by U.S. Consulates in China takes
extremely long time. Too many H1B visa holders and their families suffered
from this "administrative process".
Comments on question #3.b under I. Streamlining the Legal Immigration System:
Beneficiaries with an approved I-140 proceeds to "preregister" for
adjustment of status (I-485) even there's no visa number available. So that
they can apply for the Advanced Parole, which is critical for the families
suffered from the backlogs.
Comments on question #16 under II. Ensuring Use of All Immigrant Visa
Numbers:
Wasted visa numbers from past years should be recaptured to reduce the
current crazy backlog.

EB相关的改革
1,允许有I-140的受益人及其家庭申请EAD/AP
2,加强EB-1C高管的审核,并禁止造假的公司file该类申请若干年
H-1B相关的改革
改进系统以制止ICC为同一自然人file多份申请的abuse行为,并禁止这些公司file申请
若干年
I-485相关的改革
来自中印等国的申请人的申请应该首先被考虑,因为排期随时会倒退。
3. What are the most important policy and operational changes that would
streamline and improve U.S. Citizenship and Immigration Services (USCIS)
processing of the following types of immigrant and nonimmigrant visa
petitions?
b. Employment-based immigrant visa petitions
First, it's important to let beneficiaries and their family dependents of an
approved I-140 to apply for I-131 and I-765 without filing the I-485, so
that the family is able to seek job portability and better career growing
opportunities. This will be very helpful to create more tax sources and keep
these high-skilled workers, who were most students of US high education
system. It's a loss to US to let them leave because of the inefficient
immigration system because US has spent tax payer's money on their financial
aids of their education.
Second, USCIS should strengthen the audit of filed petitions of the highly
abused EB-1C program, and ban some employers for some years of filing such
petitions. The EB-1C class (aka multinational managers) is abused by many
Indian staffing companies and even some top Indian companies to import fake
managers and apply for green cards for these less qualified people in months
, while other real high-skilled workers are suffering from the backlog of
years or even decades. Most large and good faith employers (e.g. top 500)
won't abuse and they seldom file such EB-1C petitions, because everyone
knows US companies lacks high-skilled workers especially in STEM specialties
rather than managers. This kind of abuse not only hurts qualified US
managers, but also is unfair to those honest high-skilled workers waiting in
the lines for years.
c. Nonimmigrant petitions
e. H-1B temporary worker visa petitions, specifically, ways to reduce
burdens on employers and workers engaging in the H-1B petition process,
consistent with protections for U.S. and temporary foreign workers. (Note
that employment authorization for certain H-4 dependent spouses of H-1 B
nonimmigrants was a part of the President's November 20 announcement
described above, and recommendations regarding that topic should not be
submitted here.)
USCIS should also stop the abuse of the H-1B program, and ban some employers
from filing petitions for some years. Still some Indian staffing companies
and even some top Indian companies file multiple petitions for the same
beneficiary to increase the possibility of computer draw in case of too many
applicants filed on the 1st day of a fiscal year. This is because the USCIS
system is not able to distinguish such abuse. This results to waste of the
annual quota, hence reduces the tax source for the federal government. And
this is also unfair to honest employers and their beneficiaries.
5. What are the most important policy and operational changes that would
streamline and improve the process of applying for adjustment of status to
that of a lawful permanent resident while in the United States?
First, applicants coming from countries with a "cut-off" dates rather than "
Current" should be considered and processed at a higher priority, because it
's possible for the "cut-off" dates to be retrogressed and hence the
applicants and their families lose the opportunity of adjustment of status,
and have to wait for another round of years' waiting to be current again.

问题是到底有没有用呢? 分享一个我看过的例子: 当Dodd-Frank出来的时候, 它授权
CFTC制定一个法案去规定speculator在商品市场的position limit. 所有的wall
street banks 和hedge fund 非常不爽,基本断了他们的财路.所以当CFTC拟了个草案
asking for public comments, 这帮人和他们的lobbists几个月发给政府about half
million comments,基本上重复一个message - limits are not good for markets。
结果 法案拖了N年,最终不了了之,其中一个原因就是 public are against it based
on comments。所以说当有足够的人发声表达同样的诉求,一定会有非常正面和对我们
有利的影响。大家加油!

15. What are the most important policy and operational changes, if any,
available within the existing statutory framework to ensure that
administrative policies, practices, and systems fully and fairly allocate
all of the immigrant visa numbers that Congress provides for and intends to
be issued each year going forward?
Comment: I have been in the Board of Directors and Executive Committee of a
national immigrant organization with thousands of members for many years.
One of the most frustrating issue our members have been suffering is the
nontransparent process of the Visa Bulletin issued by Department of State.
We often see the Cutoff dates of certain immigrant categories moving back
and forth wildly and some cutoff dates are often set wrong based on our
internal statistics. Particularly, we have suggestions below:
1. Publish the I-485 inventory data http://www.uscis.gov/green-card/green-card-through-job/previous-pending-employment-based-i-485-inventory/pending-employment-based-i-485-inventory monthly instead of quarterly.
2. Publish the Consular Processing data http://travel.state.gov/content/dam/visas/Statistics/Immigrant-Statistics/WaitingListItem.pdf monthly instead of yearly and tabulate the waiting list in the same format as the I-485 inventory.
3. Publish the actual approved visa numbers for oversubscribed countries
monthly instead of yearly in the same format of the "Immigrant Visas Issued
and Adjustments of Status Subject to Numerical Limitations" http://travel.state.gov/content/dam/visas/Statistics/AnnualReports/FY2014AnnualReport/FY14AnnualReport-TableV.pdf
4. Created an integrated webpage to publish the above numbers and these
numbers should be available to public with 1 week of each end of month.
5. DOS should admit that the allocation method of Spillover numbers in EB-2
category is not detailed in INA and the current allocation method is not
reasonable. The Spillover numbers should consider both Diversity and
Priority Date.
6. DOS should exclude FB-2A Exempt numbers when calculating Family Fall
Across numbers because FB-2A Exempt numbers are not subject to Per Country
Numerical limit per law.
