perm工资比我现在的薪水多了近30%!!!律师都担心140会被RFE,但所幸140已经批下
来了。
我的疑问是,那到底是提交485时要match工资,还是拿到卡后再match呢?
雇主会不会在我拿卡后,支付perm工资一段时间,然后又降回到现在的水平呢?如果这
样,我该怎么办呢?
唉,我这么问,是因为我们部门整体薪水太低,我的perm工资,比同部门的senior还高
。要是只涨我一个人上去,其他人(还都是美国人)肯定得不爽,难道要按一定比例,
同部门所有人都涨?(如果真是,那我可真是他们的福星啦)

140 485时候要求公司的EVL什么的,就只是口头承诺?那个时候公司若变卦,移民局也
睁只眼闭只眼了?

你们senior还不到perm level 2的工资吗?
唉。。。。业务能力一般,专业太冷门,跳槽不容易啊。。。

程师level 2来做的。我们的senior确实还不到我的prevailing wage。
不知道将来绿卡拿到后,到底会怎样啊。。

s********c 发帖数: 4152 | 15 不要吓唬他了,职业移民绿卡本来就是一个意愿性的测试,只要当时你申请的时候都符
合就能拿到卡,至于拿到卡后干什么,拿多少钱,还是不工作在家歇着谁管得着?至今
还没听过拿卡跳槽,或因为薪水少了,而不给入的,就算你拿到卡后在家呆着不工作,
难道就不给入籍了?
再或许你说的是对的,难道不能多等半年等到薪水涨上去,或找到一个给这么多钱的工
作?从拿到卡后的5年半再入籍?反正只查前五年的工作情况。
还有一种情况大部分中国人交了485后都是超过180天的,如果是这样,拿卡后就更不用
担心马上跳槽影响了。
一句话就是拿到卡后你就自由了。

什么时候match?
Under immigration law, a misrepresentation of a material fact is considered
a fraudulent representation. In every PERM case, the employer recruits for
the “open” position at the wage it represents it is willing to pay—which
wage is the (determined) prevailing wage. When is it required to do so?
From a ‘credibility’ stance and to ensure that the employer is never
accused of engaging in misrepresentations, we would recommend that the
employer would pay such wage or close to such wage as soon as the
recruitment ends and the worker is hired based on such recruitment…..BUT,
you ask: is the employer required to pay the wage before the successful
foreign worker obtains her permanent residence? Technically, pursuant to
Immigration law, the employer can pay the Prevailing Wage as soon as the
applicant starts work as a permanent residence (or upon approval of the I-
485 Application). But, employers are bound by other laws as well, and thus
we always recommends that the employer’s actions be consistent with its
representations.
可不可以拿卡后match,之后又降回去?
Please understand that if an employer has a preconceived intent to reduce
wages below the prevailing wage, then an employer is contemplating fraud,
which it must NOT do. Such preconceived actions are impermissible!
We recognize that circumstances can change—for the better and for the worse
and employers respond to same. An employer might have fabulous revenues
permitting generous raises and bonuses. In contrast, an employer might have
unexpected financial woes resulting in its having to fire workers, reduce
hours, reduce salaries; go out of business. All employers make decisions
based on unanticipated/changed circumstances. |

公司不愿意冒险,我们说没问题没用,律师觉得不行,公司又不愿意提前支付
prevailing wage,所以我只能等EB2了,降级是没戏了。说白了还是自己不够牛,够牛
,我拍屁股走人,看他们要不要人。
