On Feb/13/2006, Department of Labor proposed a rule to prohibit alien
payment for their cases. The document is available on Federal Register as
Vol. 71 No.29 20 CFR Part 656. This is a excerpt of paragraph 3 of page

The Department proposes to include in this prohibition a ban on alien
payment, directly or indirectly, of the employer's attorney's fees and costs
related to preparing, filing, and obtaining a permanent labor certification
. Employers, not aliens, file a permanent labor certification application
and, therefore, these employer costs are not to be paid or reimbursed in any
way by the alien beneficiary.
On May/17/2007, Department of Labor finalized the rule and made it a
regulation. This document is available on Federal Register as Vol. 72 No. 95

Ban on sale, barter, purchase, and certain payments—This Final Rule
prohibits the sale, barter, and purchase of applications and approved labor

485理论上还真是属于个人的。

弟说的1万2的费用，就纯属欺负你不懂的明抢了。

费用还是很可观的。

就不给你办。

以后公司拿合同出来找你要钱，你就把这个ban的原文发过去，合同违法所以无效，我
不能违法交钱给公司，而且公司也不能违法收钱

得无大关系，反正不就是买卖劳动力么，不需要那么多情面，反正已经被压榨欺负过了

里确实没有H1B和LC的费用，可见公司也懂一些。费用多数是140，485， 多次
EAD和APrenew的费用。
我看了一下2003年签的那个合同，说得是
“if employee voluntarily leaves the company and if the petition for
permanent residence is pending or within 12 months from the date the
employee acquired resident status, the employee agrees to replay all
costs incurred by the company, including legal fees and other expenses,
in connection with the permanent resident process. If leaves during 13
to 24 months, repay one half of all costs."
公司给的费用列表是从2006年底PERM EB2的I-140的费用开始列起，包括了很多次
的EAD和AP的newal（我和LD的),485的费用，取消我原来的EB2的filling 费用等，
一共近12000美元。
公司给的信说我的绿卡申请还在pending，所以我需要给他们还钱。但实际上
是我签这个2003年的合同的绿卡申请EB3还在小黑屋里，拖到2007年初的时候
被他们取消了，所以这个case应该结束了。新的case （EB2 PERM）是2006年
开始做的，没有签新的合同。现在公司拿着这个旧合同要新的case的钱。
我回信给他们说我的旧case已经被取消了，没有pending，所以不应该还钱。
结果他们直接把case给了讨债公司。
现在我还是想知道我应该怎么办？是跟原来公司的HR联系说我不应该付钱（因为
新case没有合同），还是付50%的费用(按照旧合同说得），还是直接跟讨债公司
讨价还价少要钱？我还是不想跟原来告诉闹翻了，是300强的公司，在当地还是
还有实力的，我还是希望以后回原公司。当地几乎没有大公司，工作机会少些。
还是找个律师咨询一下？是不是华人律师也可以？有没有推荐的？大约费用
多少？在美东。
