Act. I appreciate your input on this critical issue.
Representative Jason Chaffetz (R-UT) introduced the Fairness for
High-Skilled Immigrants Act (H.R. 3012) on September 22, 2011. This bill
was passed out of the U.S. House of Representatives by a vote of 389 to
15 and has been reported to the Senate for further debate and review. If
enacted, this bill would amend the Immigration and Nationality Act by
eliminating the cap on the number of employment-based immigrant visas
and decreasing the number of other visas, such visas sponsored by
resident family members. Currently similar legislation has not been
introduced in the Senate.
I believe that Congress should continue working to deliver comprehensive
immigration reform. Major religious denominations, law enforcement
leaders, the labor movement, business owners, civil rights leaders,
economists and a majority of Americans agree that our current
immigration system is broken. Immigration reform is vital to getting

You will be pleased to know that I support legislation that eliminates the
per country limits for employment-based green cards and increases the per
country limit on family visas from 7 to 15 percent. This provision was
included within my Comprehensive Immigration Reform Act of 2011. My
legislation also ensures that unused visa numbers in a given year will "roll
over" to the next fiscal year; recaptures unused visas; and includes STEM
reforms that exempt individuals in the science, technology and engineering
fields from the limits.
We must look to enact practical, smart, and substantial immigration reform
that reflects current economic and social realities, respects the core
values of family unity and fundamental fairness, and upholds our tradition
as a nation of immigrants. Please rest assured that I will keep your views

Dear XXXXX,
Thank you for contacting me about H.R. 3012, the Fairness for High-Skilled
Immigrants Act. I appreciate you taking the time to share your thoughts with
me on this important issue.
I think we can all agree that the current immigration system is broken.
Until the system is fixed, Minnesota families, businesses, and communities
will continue to suffer. Our nation needs comprehensive immigration reform
to secure our borders, enforce our laws, meet the needs of industry and
agriculture, and bring a large and growing population out of the shadows and
onto a tough but fair pathway to citizenship. The best way to do this is to
enforce immigration law at the worksite, create a pathway to citizenship
for immigrants who work hard and pay their taxes, and re-examine the
economic and trade policies that have created the conditions that make
illegal immigration an attractive option.
Currently, the Immigration and Nationality Act limits the number of
employment-based visas made available to any country in a given year to no
more than seven percent of the total number of such visas made available.
This limit has led to a backlog of thousands of skilled, legal immigrants
who cannot receive visas because their country of origin has reached its
percentage allotment. This hurts American businesses and the American
economy.
H.R. 3012, introduced on September 22, 2011, calls for eliminating this cap
on the number of employment-based visas that may be granted to immigrants
from a single country. Proponents of this legislation argue that removing
the cap will allow American businesses to hire the best foreign talent,
regardless of their country of origin. An identical bill, S. 1857, was
introduced by Senator Lee and has been referred to the Senate Judiciary
Committee, of which I am a member. H.R. 3012 was passed by the House on
November 29, 2011, and was subsequently referred to the Senate. Please be
assured that I will keep your thoughts in mind when this legislation comes
before me in committee or in the full Senate for consideration.
