在美国境内的配偶递交dependent 485，当然，she has to be legally in the States

问题：
1) If my girlfriend and I get married AFTER I submit i-485 (but pending),
and she comes to US using H-4 visa, can she still apply GC as my dependent
by just submitting another i-485? Or it has to be submitted together with
mine?
回答：It can be submitted after, and is much better if your case is still
pending when she files. It gets confusing if she files after your green card
comes through, even if you were married before you filed.
2) If she cannot submit 485 separately, how long does it usually take for
her to apply GC as my spouse? To my understanding, she has to wait till my
485 is approved and has to maintain in H-4 status?
3) If the safest way is to get married before I submit 485 and apply as
dependent together, then she has to be physically in US when submitting 485,
right? How long does that period need to be and can she leave states for a
while after submission?
回答：Yes, she must be here to file the I-485, but there is not period after
the filing that she must wait as long as she has a valid H-4 status.
追问：
It is very good to know that she can file 485 after I submitted mine. But if
we officially get married after I submit my 485, is the previous answer
still valid? Want to get clear of the options, cuz this case can be true if
my PD become current next month.
回答：If you get married after you file the 485, but before it is approved,
then she is probably still OK. But, the risk is that CIS will approve your
485 before you get married, which would put her in a terrible filing
category and almost certainly keep her abroad for a long time. The best
thing would be to get married before you are eligible to file your 485 and
to file hers at the same time. |
