1. 印度开始使用spill over就意味着他们用完了本年度quota，我们也要求在5月份用
完quota+spill over
2. 要求奥把12000个名额5月份一下子都放出来，理由是uscis处理比较慢，早点放出来
便于有时间处理，不至于浪费。
大家集思广益下，看看有什么好的要求和提出的角度，英语牛人可以草拟一下给奥傻得
信件，通过NIU发给奥傻。

中国还没有到quota，必须给够我们才能让老印使用spill over，否则是违法的。

发帖数: 1782 | 3 不错。现在EB2C还有1千多没用完，应该Push O赶紧用完，
拿这个作EB2I可以用SO的条件。不然的话要求先Vertical
Spillover,EB2I只能用EB1I的剩余名额。我记得以前老O
的一个借口就是关于垂直SO和水平SO的。

Dear Mr. Oppenheim:
This is New Immigrants United (NIU). We are sending this letter on behalf of
tens of thousands of legal immigrants from P.R. China in employment based
category 2 and 3 waiting for visa numbers.
First, we would like to express our appreciation in your effort in pushing
forward the cut-off date. In FY2011, we noticed there are positive signs in
resolving severe backlog of Chinese employment based immigrants. We are
hoping that with close communication between you and NIU, we can do even
better.
This week AILA has reported that “at least 12,000 additional numbers will
be available to the EB-2 category” and “This situation will allow me to
advance the India EB-2 cut-off date for May”, based on your communication
with them. India demand has the largest concentration of early dates, any
substantial movement of Indian EB-2 will use up their yearly quota and start
using “otherwise unused” visa numbers (spillover). Based on our analysis
Chinese EB-2 pending cases only decreased by 1350 from Oct.2010 to Mar. 2011
, which means we are still 1450 away to reach yearly quota. According to the
immigration law, no country can start using spill over visa numbers while
another country’s demand cannot be satisfied (Priority date is not current)
and has NOT reached the yearly limit of 2800. Thus approved Chinese EB-2
cases must reach 2800 before any other country can tap into the spill over.
On behalf of our members, we have the following requests:
(1) Move Chinese EB-2 priority date forward enough in May 2011 to reach its own yearly limit of 2800 before any country taps into “otherwise unused” visa numbers. This won’t be achieved unless Chinese EB-2 priority date for May 2011 moves to Oct.2006 or later.
(2) Allocate “12,000 additional numbers” all in May 2011 to avoid any
possible wasting. This will ensure USCIS has enough time to process/approve
all cases and use all these visa numbers in FY2011.
From our previous communication, we understand you are a very nice person
who is willing to help us legal immigrants, and help to solve the severe
backlog. Here we provide suggestions that consistent with our current
immigration law and policy. We sincerely you would consider this.

不过 好像 有 一 个 单个 国家 不 能 超过 7%的 说法。 可以 拿这个 做做文章。
这样小印拿到的 名额就有 上限 了。 这样 小印就不会 和 中国 捆绑了。 |

不过混了这么多年，看过的分析实在太多，记不住什么条款了
当然也有可能没这个条款。但这个逻辑和policy都是奥傻的

He always say we use more than INS allows, but why the pending only decrease
by 1350?, I don't think there are many eb3 chinese upgrading.
