My company is sending me to another country for work. The project is for 1
year but could be extended for another year. Currently, my 140 is approved
and the 485 pending. The PD is still sort of far away. But I am wondering...
What would happen if my GC was approved and I was not in US? The company
lawyer told me I would be fine as long as I had somebody send it to me.
If I go to another country for work, do I have to change my H1B? The company
lawyer told me NO, because it would be just temporarily relocated for work.
The company lawyer told me I won't be able to get AP for this assignment because of the long period, so I have to get the H1B re-entry visa every time.
But I don't trust the company lawyer. So I come here for your advice.

发帖数: 1987 | 3 你payroll还在美国吗？如果不在，到时候万一RFE要你给出pay stub，可能就有问题。
如果payroll还在美国，H1b就在，H1b在，485转身份应该就没问题。否则你可能就要改
成领事处理，在境外等那种。
另外，据说用AP不影响H1b身份，用EAD才影响。所以你应该可以申请AP，同时又申请
H1b visa，AP作为备份。不过你要是在外面那么长时间，完全不用担心check时间长，
AP备份没必要。H1b最多就是check，不会拒签。 | G*******g
