My company lawyer filed my EB3 China labor certification on 10/2003.
Then in 04/2006, they told me they converted old pending LC to PERM
and recaptured the earlier priority date of 10/2003. The PERM get
approved and I140 approved based on that, in 07/2007, they filed EB3
China I485. They always insist the old PD is recaptured, so my VB should
current now. Now they told me due to some unexpected filing error,
the old PD of 10/2003 were NOT captured properly and my
PD is indeed 04/2006.
They are trying to push me accept the fact, or get the "free" upgrade
to EB2 with them.
What shall I do?
File complaint to state bar? Hire a malpractice lawyer? Now I have some
strong aversion to deal with lawyers, also there is no much profit.
I suspect no lawyer will care?

them that since mistakes have been made the first time, this time you want
another lawyer to double check the filing before whoever does the paperwork

As long as the old PD is not recaptured(no matter who made mistake), it can
not be recaptured.

发帖数: 3027 | 4 not a problem. As your I-485 is not submitted, simply attach two I-140s,
with older and newer PD, and ask explicit to carry over the earlier PD. This
is the way that attorney should do. Just need to refer to some pdf memos
about this.
