这个月他的排期到了，我与9月1日递交了I485， 但是今天知道他的绿卡于9月2日批了。
请问这种情况下，我需要重新递交I485吗？我需要从“同时申请”转变成“follow-to-
join”吗？
如果是要变成“follow to join”的话，请问一般要等多久才能拿到EAD和绿卡呢？

因此，不用重新申请。

The most important thing is to make sure her H4 status won't become illegal
because of the approval of my GC.

The Cut off date for Spouse of Green Card is in 2010, so it is about half
year waiting time.
Also I think USCIS has at least 180 days tolerance of being out of status.
Please talk to your attoney to confirm that. |

current, that's why she can submit 485.
@ LZ: "follow-to-join" is just a term for the situation. there is no

situation should not be called follow-to-join.

发帖数: 191 | 14 Follow-to-join can also be used for 485 when spouse's 485 is filed after
primary applicant. The only requirement for spouse's 485 to be accepted is
that marriage happens before primary applicant's 485 approval -- so in this
case lz has nothing to worry about. Just wait for receipt.
