Usually, the lease should say, in a case when the landlord can not fix the
problem, and the problem is persistant, you have the right to break the lease
before the lease ending date without paying the early termination fee.
However, most apartment landlords require you give them certain time period
notice before you vacant the apartment. Such as 30 days.
Do not just refuse to pay the rent. It will result some big lesson which you

30 days (this number may not be accurate), saying he has to fix it or you'll
stop paying the rent.
there must be certain procedures you need to follow. you can't simply stop
paying the rent.
