今天早上收到一封律师信:
Re:Your Contractual Obligations to
Dear X:
This firm represents ("A" or the "Company"). I understand
that you have resigned your employment with A to take a position with B, the
client to whom you were assigned during your employment with the Company. I
am writing to inform you that taking such a position constitutes a breach
of your contractual duties under your agreement with the Company.
Pursuant to your Employment Agreement(the "Agreement"), you agreed that you
would not compete with A for 90days following the termination of your
employment. In addition to your non-competition obligations, you also agreed
that you would not disclose or use any of A's confidential information, nor
would you induce or attempt to influence any other A's employee to
terminate his or her employment with the Company. While the Agreement does
not prevent you from working for a non-competing business during the 90-day
period, your immediate employment with the client to whom you were assigned
constitute prohibited competition.
Because of the seriousness of this matter, I need your assurance by
the close of business on Monday, March 19, 2012, that you will
refrain from any activity in violation of your obligations under the
Agreement. If I do not hear from you by that date, the Company may consider
what legal alternatives are available to it. Nothing herein shall be
understood to be a waiver of any rights the Company may have with respect to
your current activities.
