I am writing with deep concern regarding the “Fairness for High-Skilled
Immigrants Act of 2019 (H.R. 1044 & S. 386)”, which would remove per-
country limits on permanent residency. If Congress passes this legislation,
it will add years of delay for other countries except India and other high-
skilled immigrants from smaller, underrepresented countries seeking
permanent residency. For many, such burdens would likely prove too high,
effectively ending their American Dream.
The pathway to citizenship must remain an opportunity that is shared equally
by individuals of all nations and this is a pillar of our immigration
system. The State Department has described country caps as ‘a barrier
against monopolization.’ Even a cursory examination of the State Department
’s immigrant visa statistics reveals that without these limits, nationals
from a handful of high-population countries will account for the vast
majority of green cards. This bill will also disfavor immigrants from
smaller countries who have spent years at U.S. academic institutions and
have formed deep connections to the country.
We understand that the visa process is not fair for many immigrants, however
the solution must be considered holistically. The system should not be
designed to be monopolized by individuals from large countries to the
detriment of highly-skilled immigrants from smaller countries.
The path to permanent residency and citizenship for talented men and women
from underrepresented countries, especially smaller nations in the
developing world, is fraught with difficulties. The per-country limits
ensure that the aspirations of these individuals are not obscured and our
naturalization pool remains diverse.
I urge you to keep the American Dream open to all immigrants by opposing H.R
. 1044/S. 386 and the elimination of per-country limits on permanent
residency. Absent remedial steps to protect other countries except India
immigrants dealing with an unfair system, this bill risks making the other
countries except India path to permanent residency impossible to navigate. |
