这个月被一个傻小子的尼桑撞了右侧前门和fender。对方全责，对方保险公司
Progressive。
我自己去dealer做的修车评估与Progressive给的估价差了一倍。
问题如下，
1.周五打电话给我要寄支票，我不同意他们的估价，所以不让他们寄支票，结果今天再打过去告诉我已经寄出来了，原因是车title在我老婆名下，所以寄给我老婆了，并且现在已经关闭了这个case。请问他们这么做合法吗？在我并没有接受估价的情况下强迫我接受，我可否不接受这张支票？
2.他们在评估的时候要换我的右前门，后视镜，以及fender,但是给我换的都是used part，我问他们这么做有什么法律依据，他们只说保险公司都这么做，我想要他们换给我原厂的新配件，应该怎么办？
3.我的车之前没有事故记录，这次出车祸之后对我的车价值造成损失，我要求他们赔付这个损失，他们要我出具相应的证明文件，有没有人做过这个事情，能不能给我提供点方法。
4.租车，修车期间，他们会给我提供租车服务，但是他们拒绝给我提供同样等级的车，只会给我提供一辆普通的车，这个如何跟他们argue呢？
5.我觉得我自己单枪匹马的跟他们打好像有点不给力，打电话给geico求救，因为是半保，所以他们也不想管，这种情况如何是好？
到美国第一次出车祸，好多地方都不清楚，恳请各位多给出出主意，叩谢了 |

狮子大开口要求全部新品。
你说的因为事故造成你卖车时候损失，那个可以Argue。以前新闻里面，加州，老中撞
了法拉利，那个车主最后得了10万刀赔偿因为事故造成卖车时候损失。 |

我不想用旧配件是因为担心二手配件的质量，毕竟那个门里面平时坐着的是我太太，也
没想狮子大开口。
而且保险公司这种工作态度很让人不爽，一点商量的余地都没有，自顾自就把支票给寄
出来了，显然就是想强迫我们接受

A. get cash - if you do NOT want to fix the car or want to fix it cheap
and pocket the differece, get 3 free estimates from 3 different body
shops, fax them to the insurance company and ask for as much as possible
or
B. get the car fixed - send your car to good bodyshop, ask them to bill
the insurance directly. Usually insurance company recommended bodyshop
are good; avoid dealer because most dealers do not do body work, they
tow your car to a body shop nearby and charge you $2000 extra.
Call other party's insurance. demand car rental reimbursement, starting
from the day of the accident until the proprety damage claim is closed.
get a lawyer if you want to claim bodily injury. you can spend dozens of
hours on research, paper work and fighting with insurance company. Or
you can get a lawyer and do nothing other than going to the
doctor/therapy and usually get more money into your pocket.
DO NOT, I repeat, DO NOT tell/threaten insurance company that you are
going to claim medical if they don't pay you enough for property damage.
that's the WORST thing you can do to get yourself sued for insurance
fraud.

我准备明天先去学校的法律顾问那里咨询一下了，关键是这家保险公司自己做了评估之
后不接受其他地方评估，而且态度很强硬，让我很气愤。
人身伤害方面，本来不想找他们了，其实肩膀和右侧的锁骨确实疼了几天，虽然不很严
重，但是明显有感觉，当时觉得自己大男人一个这点问题没有大碍，也不想浪费时间去
医院，所以就没提这个事情，现在看来都是我低估了保险公司的无耻程度造成的恶果。
也希望大家引以为戒吧。

you can go find an auto accident lawyer directly. find a good, reputable
one. it's free to you.
