发帖数: 76 | 1 昨天早上出了车祸，在十字路口，我直行，当时黄灯，对方车左转，结果撞上了。我整
个前面的bumper都掉下来了。对方是个kia的suv，可能是右侧被我的车头碰了。当时也
叫了警察，但是警察说这个没人受伤，他们不出report。我的车是全险。回来就report
了我的保险公司，farmers。
这个应该是对方的错吧。是不是应该直接file claim到对方的保险公司呢？因为我的
collisiondeductible是1500啊，比较高。这个事要先从自己的口袋里出吗？
想请大家鉴定一下这个是不是都是对方的错。然后保险会怎么走。我第一次遇到这事，
不知道该怎么办。

guy made left turn, we both said we were on yellow light.
since the accident happened on intersection, and police did not give tickets
to either dirver, unless you have witnesses to prove that you were in
yellow
otherwise it is hard to said who was at fault. report to your insurance
company first, let them deal with the other side.

said about accident.
unless you have strong evidents to support you are not at fault, otherwise
each driver took half responsibility of the accident, and your insurance
takes care of your car, his insurance takes care of his car.
if you don;t agree the judgement, you still can go to court and fight back.

I. file a claim with the other driver's insurance company directly. you
don't pay anything
or
II. file a claim with Your Own insurance company if you have full
coverage, then
you have to pay deductible first because you are technically filing a
claim
against your own insurance. then if it's determined it's not your fault,
your ins
company will get all the money back and refund your deductible.
on fixing the car, you have 2 options:
A. get cash - if you do NOT want to fix the car or want to fix it cheap
and pocket the differece, get 3 free estimates from 3 different body
shops, fax them to the insurance company and ask for as much as possible
or
B. get the car fixed - send your car to good bodyshop, ask them to bill
the insurance directly. Usually insurance company recommended bodyshop
are good; avoid dealer because most dealers do not do body work, they
tow your car to a body shop nearby and charge you $2000 extra.
Call other party's insurance. demand car rental reimbursement, starting
from the day of the accident until the proprety damage claim is closed.

没有必要叫警察. 在大多数情况下, 轻微事故叫警察是浪费时间。在大城市，轻微事故
警察甚至可能
根本不會來.
警察的報告也不是聖經。許多現實生活中的案件證明, 保險公司可以完全無視警方報告
, 而得出保險
公司自己的事故定案.

发帖数: 76 | 5 那我现在应该怎么办呢？是赶紧找修车铺修车，因为我是前面的bumper都掉下来了，必
须修，还是比较新的车。但是我的保险是1500deductible，保险公司只管1500以上的。
看起来我也要付一半责任，那我岂不是要大出血了？
谢谢上面的回答，但是怎么样我都不可能保各家钱给保险公司，然后保险公司直接给我
check，把修车的费用都cover吧？ |
