- from Wikipedia. 用大白话来说，就是在法庭上，老婆可以拒绝提供对老公不利的信息; 还有一层含义是老公可以阻止
老婆出庭，以防她说坏话。
“这事我不能交代，因为跟老公有关。” —— 大家肯定说这不是相当于把老公给供出去了吗？没错， 但警察不能用老婆
说的这句话来against the husband, police needs real evidence。Police can't use this against him, they need to
go out hunting for more. 也就是说，要想证明这是老公犯的错，警察得open a new investigation，想办法取证，
这可比第一次开张罚单要麻烦得多，费人费钱费时，很可能就不了了之的。当然万一警察非要跟你叫上劲了，厉害的人
能把警察玩得团团转，但你老公估计没那个能耐。
总之，在美国一要懂法；二要不撒谎、但不该说的绝对不说。

先生没有驾照，只有permit ,我有驾照，大概一个多月前（我还在中国）先生在开车
在U turn 时碰上了路边上，被警察拦了下来，开了罚单，先生比较紧张，就错把我的
临时驾照给了警察，警察就把我的信息抄了下来，但性别写的男性，也没有拍照，先生
就签了字，签的是他的中文姓名。今天早上先生才给我说这个事情。
现在马上要到缴罚单的时候，就下个月的6号，我在网上搜索了下，加州好像是要缴480
多的罚款，罚单的开头是钩的traffic 。
现在有两种办法，第一就就是我出庭，我说我没有罪，从护照上可以看出我那个时候还
在中国，我是从车上看到有一张我的罚单，我不知道是什么回事。这样的话，警察会不
会继续纠察到底是怎么回事情，因为车的车主是共同拥有者，会不会把我先生查出来，
他到现在还没有去考路考，且这个月底笔试马上要过期了，如果查出是他，以后会不会
考不了驾照？
第二，就是我不出庭，直接把罚单寄过去，让罚钱，但听说有罚单，以后的保险会涨很
多，请问怎么办比较好呢？请支招。谢谢 |

你不可以撒谎，但完全可以不合作，不提供驾驶人的身份，但是说出“spousal
privilege”就很白痴了，那就是指明是你老公
我早说过protection against spousal incrimination 不完全有用，如果prosecutor
发怒了，完全可以只让警察指认她丈夫以此作为有效证词，这看情节有多严重
所以直接抖出她丈夫就是个白痴的做法

但警察不可以根据本人目击来指控她丈夫。警察不认识她的丈夫，而且这是关于老婆是
不是开车违规的案子。证据明显表
示：老婆不是当事人。案子就结束了。警察想告老公，得从新立案。

根基给予保护。而如果提及了spousal privilege，法官就无权再问了。

spousal confidential 只限于夫妻间的对话。

当然如果法官不问，妻子当然不用提及spouse privilege.

（１）老婆为何知道这张ticket的来源？是因为老公私下告诉她的，不是第三方指证的
。（２）老公希望老婆告诉法官和警察吗？ 不希望吧。
所以万一法官问为什么老婆拿到这张ticket，谁当时在开车时，老婆就可以说我不能告诉
你，因为配偶特免权允许我不回答这个问题。
Mention spouse privilege巧妙之处在于老婆避免直接回答问题，同时控告方不能因为
老婆用了spouse privilege就把矛头指向她老公，因为老婆的这句话不能用来拿来当证
据。
很多同学说那个警察可以指正呀。（1）警察凭什么说那天开车就是老公，警察又没有
她老公的照片。（老公最好那天别去法庭）。（2）警察那天不一定会出庭。（3）警察
得回去做调查，重新立案。这个case可以升级到criminal case，因为老公出示了别人
的驾照，属于欺骗警察。但被告可以反驳一个连男女都搞混的警察，他的判断能力可信
吗？而且事隔多日，警察能记得清长相吗？警察错过了在犯罪现场当场取证的最佳时机
，以后再进行调查要麻烦得多，也给辩护方提供了很多反驳理由。
最后两点：
1． 警察最爱不问自招的人，最害怕遇到守口如瓶的犯人或嫌疑人。
2． 各个州的法律不一样，对spouse privilege 的运用可能会有些出入。跟我较劲
的童鞋们如果从这点上下手，也许还有可能找到某个州有某条特别的规定…
