但是由于一撞车后那人马上就开去路边，没拍到撞车的情景，只拍到两辆车各自被撞的
地方。。

人，如果有马上要电话和名字，然后在找警察。当然记下对方的车牌也非常重要，通常
手机照个相就可以了。 |

这个事故个人认为首先要证实撞车的地方没有任何的路口，包括很小的drive way或
parking lot出口。如果没有任何路口，那么在这里u-turn就不是正常人的行为，从而
在法庭上比较有利。
当然对方当时如何向警察说的也是很重要的，相信当时她不可能编出u-turn的荒谬言论
。如果那个警察能来证实对方当初不是这么说的，那对方就没有任何机会了。 |

我可以确定当时她对警察的描述与对保险的描述差很远，至少她对警察说她是在那个
parking lane要左拐的，而不是在我的前方。

可是当时一撞车她就把车开走到路边了。我也不够老道，当时一看她开走了，怕自己一
辆车停在路中间被撞，就也跟着吧车扒路边去了。
之后才拍照，所以只照了车被撞的部位。。

对方就是无赖，它那破车也不要赔，然后我去索赔它就耍赖，然后它的保险也就一口咬
定不赔。

First of all, it's not practical to bring this tiny tinny accident to court.
No ambulance chaser - yeah I mean lawyer - would accept it.Simply there is
no one injured so no big money at stake. Forget suing. Bring it to Maryland
Insurance Administration.
Secondly, you only have liability coverage so you have to represent yourself
and take on a company. That's to your disadvantage. But that's alright.
Thirdly, the road & traffic condition here is key. She said she's traveling
in lane. You said she's pulling off from the parking lane. One of you is
right. Without witness, this is typical 50-50 case. Technically it's
impossible to dispute her description without witness. So let's take a look
at her description.
-- She's moving in traffic and about to make U-turn.
1. Is it a one lane traffic? Very important here. From the graph you draw it
appears yes.
2. Is it double yellow line at the spot where accident happened. Even more
important. You have to be sure here.
If both are true, she's driving illegally at the time of accident.
Be careful though, don't let her dispute above facts, item 1. is hard to
dispute but she could dispute the spot of accident - to some left turn legal
spot.
The cop is a wild card in this case. Did he take down the witness number by
any chance? Did he write the citation on the children without car seat? He
shouldn't allow her to leave with the children without cars seats. This may
somehow work to your advantage psychologically. You should try to reach the
cop and get as much as information from him. Be polite don't be pushy.
Lastly, and most importantly, how does the arbitrator decides he-said-she-
said (not that he-said-she-said) case without witness? The spots of damages.
Again, based on your description, that's to your advantage. If you look at
the accident report, it has a picture of the body in front, rear and sides.
on the side, front, middle and back. The damages on both cars hint you had
the right of road.

我一开始就一直要求对方保险公司打电话给警察，但是他们不这么做，知道前两天对方
司机编了那个事故经过给保险公司，保险就强硬的说是我的责任，并且拒绝了我要他们
联系警察的要求。
然后我才意识到要自己找警察，结果人这两天休假，要到周五才回来。
唉，还是我不够老道。也算是给各位新手提供点经验教训了。

If you do find the witness, you certainly can try to contact their insurer
first. They will talk to the witness then let you know if they agree to pay
your damage or not. Be prepared though, that sometimes the witness statement
doesn't clearly indicate who's fault it is, then eventually you have to
bring this up to the arbitrary agency.
Do some research on local insurance administration agency. This is a good
chance learn how the whole thing works.
Also the police is public service on taxpayer's money, so they should
respond to your request. Explain to him the other party is not telling truth
. First, try to get witness contact info. If that's not available, ask the
cop to recite what he heard from the witness. Their statement is generally
considered credible. |
