发帖数: 273 | 1 首先感谢XjtuGordon，cvml，weiqing和juliemzhu给我的邮件,自己在版上研究了几天
了,但还是有些糊涂.好像相同情况的人实在不多，连找了几个华人会计都说不知道，所
以想总结一下自己的情况和问一些问题，以后其他人也可以参考
自己的情况:
08年8月直接从国内来la做non-profit的postdoc（H1b），有ssn，开始所有税都扣，后
来我去hr填了个什么表（可能是8832，忘留底了），然后来回折腾了几次（开始说h1b
不行），fed tax不扣了。现在手上有w2和1042-s。其中W2的box1，2都是空的。
(1)到底该填1040还是1040NR？
到底是resident还是NR。XjtuGordon说因为不满183天，所以填1040NR就行了。但是记
得不扣fed tax后不久，收到过银行的信，说要填一个W-8BEN,寄过去后，银行说我not
qualify for an exempt foreign person, and identify me as a resident alien
person（因为h1b）.所以要填W9，说可以argue。后来 |

this means is the immigration service will resume looking at employment-
