每个人都会犯错误，如果不是家暴惯犯，你报警就是毁了他，一旦定罪，这些都将成为
公开资料，找工作背景调查都会查出来。说这些现在也晚了。推翻供述不容易，我想当
时有起码两个警察，分别把你们隔离进行笔录，然后看双方笔录是否一致，你们的应该
是一致的。你可以到那个警察局要一份报告，上面会对具体过程有详细描述，比如谁先
动手，具体研究一下。另外警察只负责抓人，无权起诉。对于零容忍的周，警察如果不
抓的话警察都会有麻烦，你们这种情况在旧金山的话，你们两个都会被抓，孩子小的话
会送到社工那里。起诉你老公的应该是地区检察官。根据你的描述，你们应该是mutual
battery,起初你是offender,但他掐你脖子并留下伤疤，可能使你们的角色互换，使他
变成offender。州和州的法律不一样，建议请家暴律师。 |

DA最喜欢打这种官司。LZ是否撤诉99%的毫无意义的。看到过身边认识人的例子。唯一
现在可以给LZ的建议是小心孩子，然后准备好自己的身份。LZ老公估计是废了，能不能

我最近被指控家暴。警察对老婆几处bruise拍照了。Arrested后保释了。已经请了律师
。该律师号称得过奖。以前做过DA。REVIEW也还不错。可是办的案子我有些疑问。
律师事先告诉我DEAL可能会是DISTURBING PEACE，建议我接受。在PRETRIAL后告诉我DA
要给misdemeanor （243 E），否则会以273.5 来上庭。还说“Missed some pictures
of injury”. 从付钱后到pretrial共见过1次。其他都是email联系。没听他给我说会
怎么与DA negotiate。我还想建议准备一封求情信。律师也说没用。疑问一：pretrial
只有一次吗？为什么会”missed pictures”？一般会给多长时间来接受deal？
因为我已经在这期间换了工作。已到其他州上班几天。如果我现在接受deal，意味着我
的社区服务和probation要转移到另一州。律师说要45天转移案子，期间我要一直待到

和老公吵架，我一气之下报了警，争执中他双手掐了我脖子还踢了我，我如实写了笔录
，警察的那份没有注明我先推了他，我自己写的提到了我先打他背。他被抓的时候也认
了罪，说老婆说的都是事实，但是那时候他不知道我很气所以只说了他的不是。
他们还拍照了我脖子上的勒痕作为证供，事态严重到不让保释。
我想请问上庭的时候我要是推翻证供说他没掐我，脖子上的是过敏，可以帮他撤销罪名
吗？他们会不会反过来告我给假证？
还有别的方法不留下污点吗？
吵架我们两个都激动了点，我做了过激的动作逼他发火，本以为报警可以吓吓他，没想
到搞的这么严重。 |
