弯曲很多房子都有unpermit的建筑,估计这种情况不少见,大家都怎么处理的?

p***e 发帖数: 1318 | 7 这种事是比较麻烦。 建议可以先看一下disclosure, unpermitted room应该在
disclosure上,要不然是seller的错。如果有disclose, 可以看看什么时候建的,
如果很老,可能可以被grandfather. 如果新,可以试试找到原来的contractor问问
看看是不是有违章的地方,还是只是偷懒省钱,没有申请permit. 找新的contractor
的话,最好先问问一个熟悉santa clara的。先大概有点概念,哪里可能违章,
cost多少。要是setback violation的话,可能没什么好办法弥补了。
也要房黑到底!

听说一个unpermited的房间7年后city就不能追究责任了,何况这个东西是前owner 20年前面修的,我们买的是银行的sold “as is” condition的。

for resell or refinance. Only few lenders can accept property without
permit with higher rate. many clients will not choose the unpermit property
to avoid trouble.
It also depend on appraisers. If they put your property "subject to" on the
report, you will have trouble. But if they just ignore the unpermit
construction and doesn't put anything in the report, you will be fine.

would know that unpermit condition will discorage seller and impact his
selling power. He suppose to disclose to the buyer in the disclosure at
first place. If he is really innocent, he should check NO in the item that
he is not aware of the unpermit addtion for the property.
Did your appraisal report mentioned about anything for the unpermit addition

The listing agent should provide this informaiton for you. Buyer should
disclose the unpermit addition to the buyer. With unpermit addition, you
will have some restrictions on the loan since alot of lenders will not take
such property. |

2. You will have issue for the loan. The best rate lender will not take

其实任何的装修都应该申请permit. Contractor知道有人会来检查,多少都会认真一些
, 以后可能会省很多麻烦。
有些unpermitted work, lender是不给做贷款的,很多人不知道, 等做了appraisal之
后才知道,四五百块的appraisal fee就白交了 |

好多房子公然就在listing里面写 unpermitted ...
唯一的问题就是如果以后和邻居闹翻了,邻居可以去City complain外面加盖的房子,

appraiser/bank/insurance never cared about the permit in the last 6
refinance that we did.
Also, the unpermitted area is always sold at lower price - the same
situation if LZ sells the house later.
Ask your agent/friends is probably the best for LZ |

escalated it to my attorny and the mortgage company (citi bank). The title
company pulled the county record against the appraisal report and found the
difference.
The extenion was done in 1973 (a family room and a deck), the owner had the
permit but didn't obtain the certification of completion after the project

However, every one's case is different. You might not be able to choose the
lowest rate lender due to DTI, unpermit addition, condo, credit score, visa
issue, COE....etc
But no matter what,if you already locked the rate,just try to get it close
smoothly.

time you lock, the higher the rate OR less rebate you will get. Usually new
purchase will be locked in for 30 days and refinance will be 45 days based
on the recent lenders prcocessing speed. some broker like to lock it first
to gurantee the rate they promise. some broker like to lock it later once
the loan is fully approved with short time to get better rate ( assume the

by hardwood....etc, you dont need to have permit. However, if the seller
add new room, new kitchen.....etc, you do need to have the permit. otherwise
you might have some issues for the loan since some lenders have restriction
