这里把非法移民和合法移民对于是否适用jurisdiction做了非常详细的解释
而这个是否适用就是当初判黄金德是美国公民的关键！！！高院认为黄金德的父母适用
美国的jurisdiction，所以他们的孩子是公民。同理，因为现在判例说非法移民同样适
用美国的jurisdiction，所以他们的孩子肯定是公民。你们也不想想为什么1982年的判
例后，就没有人去挑战过，就是因为太明确了！！！

首次非法越境 如果有足够证据 算 misdemeanor。

故事：
晚上10点30分去机场接同事，就要到他家所在小区的时候被埋伏在路边的警察抓了。理
由是double yellow lines不能U turn，具体路况见附件图片。蓝色箭头是我行车路线
；红方块是警车潜伏处；红色条柱是现在路中间有的隔离杆。他给开的code 是21651b
，收到罚单是$405。
我想argue一下几点：
A、罚单code有误: 应该是21651a，而不是21651b。a要比b轻得多，估计能少罚一半。b
貌似是走到双向车道的逆行错误车道，而a2写的是不能U turn，所以应该是a。

在限速６０的路上开70-75.然后警察问我要driver license和保险，老婆一时紧张找了

件，但条子回来给他看时，条子说我们没有及时给他看保险证明，他罚单已经开好，叫

这次我是readmission的，之前在学校读了硕士，最后一学期有门课挂掉了，但是过了

程的时间，所以学校办公室注销了我的sevis，得回国从新申请，现在在国内，已经拿
到学校的readmission的I-20了，不知道去签证的时候如何解释呢，怎么回答才好，应
该注意些什么问题，学校结束我的sevis会有记录么，VO的电脑上是否显示。多谢。

我的情况比较复杂。
本来我2011.5月份毕业的，但是挂科了，尽管这门课补考了一次，我竟然错过了
deadline交project，所以FAIL了，我也没有十分清楚这一门课一定要过，因为我看到
网上说至少修满18个学分，这个我已经达到要求了，所以当时没有在乎，也没有把挂科
的事情给国
际办公室说，当时我也没有去系里面拿学位，因为可以随时去拿，所以系里面也没有发
现。那学期就这样结束了，"毕业”后我就继续呆在学校在接下来的一学期旁听一

问。即使motion to open （不知道可不可以用这个），直到出结果之前都累计
unlawful presence，但是如果最后被批准了全部清零，否则继续累计。超过6个月3年
不能签证，12个月10年。 |

先别担心extension不过，除非你自己直到有什么硬伤？你是不是在担心积累unlwaful
present day，你的担心也不是没有道理，你并不是一定要离境，取决于你的extension
到时候有结果没有，如果没结果，那算extension pending，你可以不离境，凭借
extension的receipt， 你可以合法在美国，但是要注意，如果你H1b过期后，
extension最后剧了，那过期后的时间算unlawful stay，如果在你H1b过期之前有结果
，要么通过，万事大吉，要么没有，你公司应该会appeal的，那appeal期间你也可以呆
在美国，不过能不能工作这点我不太肯定，最后appeal没过的话，也会积累unlawful
stay，你开始找工作也是一种选择，但是小心别被老板发现。 |

detainer and proceed with eviction. 到时候你会被传唤，你不但要负责没交的房租
，还有庭上各种费用。
当初要转租，应该事先咨询房东。现在C走了啥问题都没有，全落在LZ身上，因为黑子
白字只有你的名字在上面。所以房租没交齐，房东只会管你要，房东自己没租给C,所以
房东也不会去管C要钱，他去要就不合法了。
现在按照合同规定，房租确实没交齐，所以房东有权利给3 day notice，然后 File
unlawful
detainer and proceed with eviction.
一旦被Evict了，以后想租房子都难了。 |

the terms of a U.S. visa? ”，在I-94标明D/S的情况下，out of status应该不算
unlawful presence或者overstay,但是算不算violate the terms of a US visa? 如果
算的话，填了yes是不是会给自己找麻烦？或者反之，填了no而被发现实际上是violated
visa terms的话, 是不是麻烦更大？

unlawful presence小于180天问题不大，后果是以后签证只能回母国签。如果小于180
天的话，如果你能得到新的H1B，回国重新签证没有问题。
没有配偶可以转B2，如果你想避免unlawful presence的话。 |
