顾名思义，Trustee Sale就是委托人代理的交易。这里边有很多情况。有可能是屋主交
不了房贷，银行收了房，找的代理人做的。有可能是屋主去世，找的代理人卖房子。也
有可能就是因为屋主把房子title放到Living Trust 里，屋主自己是trustee而做的买
卖。
因为现在银行屋太少了。我们暂时不谈那一种。今天主要谈谈后边两种的Trustee Sale.
这两种情况下，房子的title都是在Trust里，这种房子的seller一般是"xxx Family
Trust", 作为seller在合同上签字的是Trustee 。
房子之所以要放到Trust里，一个原因是避免将来做probate。如果房屋的owner健在，

如果是由自己名义转账，整个版上尚无定论。经过自己研究和咨询律师朋友，认为关键
在于foreign trust的解读。3520表规定foreign trust首先必须是个trust，一般的银
行帐号不算，所以从自己银行帐号转过来的不算gift，也不用填什么3520了。至于如果
绿卡或公民，海外资产超过一定额度要上报，那是另外一回事了。

trust是一种owner形式，可以是savings checking股票甚至是你房子或车的拥有者。
有些银行不支持trust做普通账号owner，可以用POD代替。对于情况简单的单身无孩的
来说足够了。
现在美国做遗嘱很少管钱的事，都是各个账号直接定（银行账号POD，退休账号大多直
接定beneficiary）。房子也可以放在trust上。
: 这算trust的一种，不是saving，bank的选项里有一堆，基本用到的什么
mortgage
: saving checking investment auto loan IRA等等，除外还有很多其他类别，光
trust
: 就还有2/3种（今天刚好去branch看过那个界面），这个说的就是之后根据你的
要求，
: 把钱全转成trust，trust可以设立受益人，不是说saving本身有受益人

Jobs是搞了个Trust，Jobs现在也确实一分钱遗产税都不用交，但这两者没有因果关系。
Jobs不搞Trust，也不用交一分钱遗产税，因为他老婆还在。他老婆死的时候，不管搞
不搞Trust，他们都要交遗产税，除非把钱捐给慈善基金会，或者把Trust搞成慈善基金
会，这样的话子女就不能直接继承遗产。
Trust不是重点，搞慈善才是重点。他儿子女儿如果要直接继承遗产，搞不搞Trust都要
交税。
搞遗产信托在节税上的好处是，相当于把钱提前给了子女，而你还有控制权。免税的部

八年前的这个季节，从国内来到美国。来美前，博士毕业后在一研究所工作了近5年。
期间主持完成了自己的第一个NSFC课题。由于不喜欢那里的小环境，离开那里后到西北
一大学工作。幸运的是，在那里又拿到了第二个NSFC课题，加上省部和学校的资助，支
起了还算小有起色的一摊子。虽然那的科研条件比原单位差一些，但一个人在那干了近
三年的时间，教书、带研究生、作科研，每天忙碌着，干着自己愿意干的事，少了原单
位的勾心斗角，而且在学生面前第一次觉得自己还是个有用之人，所以也很快乐。无奈

薄厚原文已经发现有诸多不实，他对孩子妈妈的各种指责我也持疑。
Foster家庭有好有坏，我个人感觉坏的比例并不多，只怕比后妈坏的比例要低。
我知道黑人家庭有不少父母没能力抚养好孩子或者一方怕担责抛弃家庭，因而失去孩子
抚养权，但华人家庭里这种情况凤毛鳞角。绝大多数家有残疾儿的华人家庭都在尽力的
照顾残疾儿。因为孩子残疾就抛弃家庭的华人很少。你可能因为工作的关系，大多是看
到坏的例子，而没有从整体和文化的角度看这个问题。八年薄厚如果是黑人，算是黑人
中的好爸爸，在华人中只算做到本分。毕竟这一切是他当年的错误决定造成的。
你说的什么要保住抚养权打官司几乎是唯一出路，也是全无道理。我看到华人家庭有残
疾儿的，基本就没有靠打官司来保住抚养权，他们才是真正靠着对孩子的爱对家庭的爱
，支撑了家庭。他们对孩子的爱被别人看在眼里，所以他们对孩子的抚养权几乎就没有
被质疑过，根本不需要靠官司来保护。
你对Trust的理解也比较片面。Trust是保护那些对没有正常决断能力的孩子和病患的。
