很不好的经历，“想这样做是有原因的. 几个月前吃过一次亏. 那时我也同时得到两个
OFFER, A 雇主给OFFER 在星期一, 说明该OFFER HOLD一星期,该OFFER 一般. B 雇主在
我的不断催促下, 终于该星期五给了OFFER, B OFFER 无论工作性质, 工资, 都比A要好
,而且B的律师着重说我有receipt就可以上班. 我签了LETTER, 并把拷贝email 回B公司
, 也发了H1B transfer的材料, B 公司开始处理H1B transfer.. 这样我就拒掉了A. 结
果风云突变, 两星期后, B律师说我的工资不够prevail wage,建议B 收回OFFER, 结果
就丢了B OFFER. 可怜我退掉新屋,退掉搬家公司,机票.”
很怕这种事发生在自己身上，所以真诚请教，如果同时，或者前后脚向USCIS 寄出两个

国并且renew visa stamp。下面哪种操作比较好呢？
1。在H1b transfer开始之前，用现在雇主A 的H4 I797 approval notice去签H4，然后
入境的时候配合H1b的雇主B的I797
2. 等H1b transfer完成，拿H1b的雇主B的I797去签，但没有H4的新I797。好像如果H4不
在美国，就没有办法办H4的transfer？这种情况怎么证明H4身份呢？H1b的新I797即可？

我的情况，2011年毕业，OPT开始，2013年没抽中h1b，OPT年底要失效。2013年9月入学
ITU。之后为V公司CPT工作，然后V不能申请h1b，只有找到O这个ICC，CPT 转到O，然后
O申请到了今年的h1b。
但是O工作没几天，project被砍掉。只有unpaid继续cpt，这个是可以的。我现在还是
F1 status。
最近拿到一家offer。今天刚跟律师聊了一下。她说了几个问题，我觉得有错误，特地
来问一问。
我们现在准备继续注册ITU一个学期，用来8月开始全职工作。
她说，h1b approved即可transfer，不需等生效。但是最近这样做的case，被拒绝的很
多。所以要考虑风险。她说了2个option

所学校的位子， 对方说可以把现在的H1B transfer过去， 已经开始办理transfer。
他们H1B的transfer 过程有以下6个步骤：
1. 系里面提交申请给international office
2. international office 审核提交的材料 （10 天）
3. 向劳动部审批 – Prevailing Wage (60天)
4. 打广告 （10 天）
5. 提交H1B 申请 – Department of Homeland Security (DHS) petition (4 – 8 个
月)
6. 收到申请结果
现在估计只进行到步骤1。想问在这种情况下回国会对现在H1B的transfer有影响吗？
是不是在新学校正式提交H1B申请（步骤5）之前回美国就可以？
还有这种情况下回国签证会不会受到影响？

但律师说不行，要hold h1b transfer直到旅行回来，还要再过一个pay period才能交

15年在公司A抽到H1，10月生效了。
16年跳槽，先接了公司B的offer，基于公司A办了H1 transfer，但没有PP。
然后等待期间（仍在公司A，没有去公司B），拿了更想去的公司C的offer，也基于公司
A办了H1 transfer PP。
公司C的H1批准后就来公司C上班了，并通知了公司B不去了。
一年多以后，目前仍在公司C上班，收到了公司D的offer。
在考虑是否要跳槽时，发现公司B并没有withdraw当时的H1，并且已经approve。
也就是现在同时有公司C和公司B两个H1的approval。
这个对再办公司D的H1 transfer是否有影响？
理论上用当前公司C的H1 approval和paycheck就可以再办公司D的H1 transfer。
但是公司B那个已批准但不曾用过的H1 approval是否也需要？

为这个新公司食言、并要求我在H1-B transfer成功的30天内上班; 而我担心这样会影
响485，也不喜欢新公司里的一些人，最终放弃了这个OFFER，也就没有激活那个新的H1
-B了。
现在485迟迟未批(RD 09/02/10)，我有点担心移民局会不会是注意到我的这个H1-B
transferred？当时应新公司律师要求，给了他我的485 A# …

就是有可能被拒。之前律师也跟我说过，因为现在的公司支付我薪水方面有问题，所以有被拒的可能。
律师建议我，批下来了，再跳到新公司。因为就算被拒了，还可以继续在现在的公司干，身份不影响。
但是我真的不想干了，风险也不管了，所以还是想跳。
新公司貌似有回国继续做的机会，但是没谈过。我的想法就是，我得跳到新公司，工作一段时间，才
可以去谈这种机会啊。不然，就算等着批下来，结果被拒了，可能新公司的offer都没了。H1B
transfer一般多久批下来啊？起码我可以干上一段时间。
问题是，如果H1B transfer被拒，咋办好了？
律师说，可以re-file或appeal，但是成功率低，而且中间身份还是会有点影响的。如果re-file或
appeal不成功，就只好回国了。
还有其他办法吗？

不是非法的，因为申请处于pending状态
但并不是说transfer百分之百成功，万一transfer被deny,你已经通知或者离开了上家
，身份就马上out of status，和失业一模一样
如果是被裁的找到新工作拿到receipt就去上班也无所谓了，有上家的还是等transfer
approved了再走吧
建议楼主自己出那1000刀吧，买个放心。不然要等几个月了。 |

status immediately.
This is an insane law and makes no sense as one would have things to dispose
beforeone can leave USA.
But there is a TOLERENCE policy base don which if someone loses a job and he
files H1B visa transfer within 30 days of being layed off. In that case

we talked about it while he was waiting anxiously.
Basically, transfer means there is something in one's application that USCIS
wants to question the applicant face-to-face with. USCIS would do "request for

我是EB1B的主申请人，ld有H1b。
最近ld要换工作，新的公司在03/03file了H1b transfer。但还没有收到receipt
notice。今天是在原来公司的最后一天。估计旧的H1B很快就会被revoke了。
新公司的律师说根据AC-21 portability只要收到receipt notice就可以开始新工作。
但那个法律说得也很模糊。说什么只要file了就可以开始工作。但这个file具体是从
received data算还是收到Receipt notice才开始算，不是很清楚。
现在有一个疑问是在旧公司ending date和新公司starting date之间有gap的话，H1B
transfer还成立么？
因为是AOS，即使H1b transfer不成立也不用离境，而且也可以用EAD工作。但既然新公

老公去年8月file的140（EB1B OR，他公司sponsor的），很快就批了，然后在10月9日
，我们的485一起file了出去；priority date和新的EAD卡很早就收到了，不过现在我
们俩还是485 pending~~ 看了身边一些例子，感觉10月9日file的，应该快到时间绿了
我刚刚收到一个offer，新公司要做H1B visa transfer，我个人比较倾向于等一等485
，但是公司觉得那个的时间不确定，希望立刻做H1B transfer，请问如果做transfer的
话，会对485的排期有什么影响吗？ 对我有影响还是会对老公也有影响呢？（EB1B是他
公司支持的）

是种种原因我跟公司B说不去了。
后来签了公司C, 现在在办transfer, 是从公司A的基础上transfer的..
请问这样做可以吗?还是说,必须得把公司B的那份797要过来,从那份上transfer..
