我应该用1040NR，作为“dual status return”， 用1040 作为“dual status
statement”。
在1040NR里面说，如果没有Gross income，就不用填1040NR，直接提供免税条款和免税
数额就行。
我没有Gross Income，在美国2010年得到的钱在5000之内，所以都免税。W2 的第一个
box 是空的。
现在，以我dual status的身份，没有Gross income，是不是就不用填1040NR，那么
1040也就省了？我也没交税，也不期望白拿钱（即使填表也拿不到一分钱）。
我现在在国内，邮信件不方便，我这种情况，是不是可以2010年不报税呀？如果不报，
以后会有什么麻烦？
真的不想弄这些都填0的表格。了解的麻烦说一下，谢谢了先！ |

背景：2011年10月成为H1B， 之前F1(含1个多月OPT)，已婚，spouse在美国H4身份
看到很多人的做法是file extension，等到2012年5月能通过2012的183天substantial
test之后，能够使2011年也能按照resident alien来报。
问题是，2011年是算以下哪种情况？
1. 全年resident alien - 似乎不大可能。因为pub 519中写道：

First Year Choice，希望2013年按照Dual Status办理. 已经file extension，现在打
算报税了，不过还有问题不明白。
今年到现在通过substantial presence test后，2013年可以按照dual status对待，我
来美后到现在一直没离开过美国，也就是来美后的所有时间都可以当作resident alien
对待，2013年以前是nonresident alien，没有与美国相关的收入，不需要报税。
我的问题是需不需要申报来美期间的中国银行账户和利息收入（填报FinCEN Form 114
）。按照FinCEN Form 114的要求，美国公民和resident需要申报，这里的resident跟
报税用的dual status 里面的resident alien应该不是相同的认定吧？
我第一个理解是，虽然报税的时候我使用了dual status,可以把来美后的时间当作

，所以你们是2014年全年resident。
你们用first-year choice才能变成dual status。dual status不能用standard
deduction。
你们用first-year choice变成dual status之后再用choosing resident alien status
才变成全年resident。虽然resident要报全世界的收入，但是那些收入不一定征税，因
为可以用foreigh earned income exclusion。可以通过physical presence test（譬
如，2013年10月－2014年9月里有起码330天不在美国，所以这段时间的海外收入不用征
税）或bona fide residence test（你2013年全年是中国的bona fide resident，你

b. If she used either, her status will be I-485 pending. If I-485 is denied,
she can change status back to H-4 assuming you maintain H-1B status. But

，当时也没有到i-20签字90天。我考古了一些帖子，感觉这个应该不是问题啊。因为要
求的是change of status to non-immigration visa 之后要等待90天，可是opt 申请
并不是change of status,因为opt是f1签证的延伸（专门问过学校isso，说opt不是
change of status, change of status 填写的是i-539，我们正常申请是不需要的，只
有被拒后reinstate才需要）所以我就在10月一开闸就递了。不过我不是专家，这个只
是个人理解，不是很确定，听你这么一说也有些担心了。。。。。。希望有更确定的兄
弟姐妹能帮忙补充。 |

发帖数: 433 | 18 你没有说明你的签证类型的具体情况，很难回答你的问题。
如果你有out of status，你的I-94就彻底失效了。之后必须出国激活，拿到新的I-94，
如果没有新的I-94，那么你以后所有的时间都是out of status，远远不止5个月。485的
时候就会查出来的。
但是查出来，并不代表一定会有问题。关键看你是什么类型的签证，I-94上面的写的
expiration date是一个具体的日期，还是D/S（DURATION OF STATUS）。
如果是具体日期，那么就麻烦了。如果是DURATION OF STATUS，那么还有挽救机会。

. 不过你有co-PI的proposal如果co-PI对proposal有贡献不能申请career吧，否则co-
PI可能会不爽。我一般一看到status变了但PM没变就考虑这个proposal还能往哪投。我
的proposal status一直没变，也快7个月了,NSF网上我这个program的还没出一个award

会不会可能是因为OPT，而显示的change of status pending？
OPT卡上个礼拜收到的，H1B是4月1号递交的。 |

吧。。。
基本上说来，只要change of status的申请是pending状态，提交申请的时候你有合法
身份，你就不是out of status。 |

就是类似于 酒店的status challenge 给我个金卡或者白金什么的 然后必须在90
天内满足一些要求
而不是 先match 然后满足要求.... 因为没有delta 或者 us airways的status去
match....
最近要飞20k miles 所以想问问有没有不需要match的status challenge

如果定几个月之后的房，入住的时候就已经不再是gold会员了，那时候会按照当时的普
通status吗？还是订房时候系统显示的高级status？前台办理入住时候会即时重新查询
审核会员资格的状态吗？ |

准备明年春季入学，今年暑假8月submit I-539应该时间是来得及的（也不敢submit的
太晚，看有的case补材料什么花了半年多的时间）
但如果很早（比如10月或11月）就被approve了
从那时起status就是F1了，但那时不能满足full-time study的要求
怎么办？这个算violate status吗
（看规定F1只有I-20的start date前的一个月时间的缓冲期可以不必保持full-time
study） |
