发帖数: 1 | 2 今天在移民网上查到自己EB1B NOID reponse 以后被拒的消息，整个过程苦苦等了一年
，心里实在是很难受！

老婆去年OPT extension用完，接下来一直靠着I-485 concurrent file给的EAD卡工作
着，这次EB1B 140被拒意味着她的EAD卡即将失效。本人还好能一直靠着O1身份继续撑
着。目前485状态还没相应更新，但也是迟早之事。
问题来了：请问从现在起，我老婆是不是要立刻离境重新在国内申请O3再回来？还是我
立马让公司律师给她file一份O3，她在美国境内转成O3身份？（比较头疼的是她OPT
extension的grace period已经用完，请问她能否顺利在美国转成O3身份？）

请问会很严重么？大约会延迟多久?
是说the requirements for my position有问题, need to provide them with
substantial proof that the position does in fact require the listed years of
experience and education。我是phd+不到1年经验。PERM广告上要求MS+4 or PHD+0.
还写了experience can be gained during Doctoral Program.是不是写得有些欲盖弥
彰乐？
律师说没事，但我觉得可能是他们材料没准备好。现在律师让我准备各种资料写个
business necessity reponse。sigh |

首先它没有defend在第一季度issued/allocated多于27%限额的错误，说明他们是承认
这个错误的。另外EB3-ROW配额不应多于34718 (140000/3 - 4*2987 (C,I,M,P)), 但是
它在2009年第一季度allocated了22972 (66% of 34718)给ROW，而只allocated EB3C
833 (31% of 2698),这造成了排期在后的ROW先用完visa number,以致排期前的EB3C无
visa number, 这显然是区别对待，厚此薄彼。如果他们狡辩说多放case是为了不浪费
名额，那么历史数据显示EB3C的返回率更高，为什么放给EB3C 31% 而給ROW 66%？
不能用实批的数据作证据，defendant's reponse里已经狡辩了：没拿到7%是因为有很
多人不合格，我们已经给了2569个pending cases了。
本人才疏学浅，只看到这两点他们没有/没法辩解。请高手指正。 |

Sorry for not typing in chinese. Since she doesn't have an account, I am
posting this for her.
My friends is a EB2 with PD 4/14/2006. She filed service request on 9/8/
2010 for her I485 application.
However today she received a response from USCIS based on my service request
" at this time, there is no visa available. When there is a visa available,
your application will be processed."

但在USCIS上查状态. 上面写着在60天内会收到written desicion. 可我什么都没收到.
状态一直就是Request for Evidence Reponse Review. 已经有半年了. 当然我的排期
也没到.
请问这是正常情况不?

I called USCIS this morning. I was transferred to a level 2 officer.(Thanks
for the detail instruction on how to call USCIS.) He send a message to the
officer who has my case. He cannot tell me if namecheck passed, or any other
status on my case. but told me that they will respond by mail by April 18.
Has anyone got response like that? what could I expect? I am getting really
nervous. |

I did SR online, got response in 10 days, which said my case was pending.
Sent email to [email protected]
/* */ to request more info, got
reponse in 10 days. The email was saying the exactly same as what you got. I
replied the email to provide more info of my EB3 I-140, like case number
and so on. This time I got response in half hour. The email said "Your file
is currently being sent to an officer for review".

非常感谢版主以及版花啊,去年降级成功,而且换了一个喜欢的工作.
今年又运气好,自动relink了,比预想的提前批准了绿卡.
