本人，当时很热情，给我们推荐到他律师事务所下辖的houston分店的某律师那里,
sign contact for appeal and EB-1A application, paid 3.5K (total 7K)
which is 3.5K. 很快 Nebraska reopen 了我老婆的 I-485， 但我的还closed. 当时
，老婆问了好几次我们的律师要求reopen我的485.他说需要较长时间，要等。所以一直
等到现在。
连email也不回了（他们已经拿到了全额的付款）。给houston的律师发信，他也不理。
迫不得已，老婆咨询了其他律师还有移民局官员，他们说要reopen是可以的（motion
to reopen），必须在被拒的390天内完成。也就是说，因为我们请的律师的不作为，我
的485已经失效了，不能reopen了。我们损失了1000多美元。 |

我只是想把自己的经历写下来，希望对类似遭遇的同学有帮助。
我是STEM 专业，在一个nonprofit 的机构工作，OPT EAD 在2016年4月23日过期，我在
2015年12月14日提交了OPT extension 的延期，于是悲剧从这一天就开始了。 USCIS
规定不能在EAD过期的120天之前申请，我提交那天是EAD过期日之前的131天。
在提交申请的时候，我询问过学校的international office 需要准备什么材料，学校
的DSO 没有提醒过120天这个时间窗口，另外我自己也确实不知道 (怪自己功课没做足)
， 另外我们学校的很多朋友也不知道120天这个时间窗口限制，只是他们没有遇到过这
个问题。（所以学校的international office 确实也不太认真，至少没有在120天时间
窗口这个事情上对学生做好功课）。再次一定要提醒大家注意这个问题： 只能在EAD过
期前的120天之内申请，提前1天都不行！！！

前一段时间发贴向大家询问485被拒怎么办，现在终于搞定了，在这里总结一下，不然
对不起热心帮忙的大家。
大约一个月前忽然收到uscis通知，说我的case悲剧。原因是我的140悲剧了，所以没有
资格申请485。这是cis很明显的低级错误，因为我有两个140，NIW的批，EB1的拒。我
们只有30天的时间。采取的第一个措施是给customer service打电话反映错误。和一级
接线员纠缠许久终于被转到二级接线员。二级接线员发现确实是错误，于是给texas
service center message，给了我referal number，说如果3天后没有消息就再打电话
。充满希望地等了3天,音信如石沉大海。于是又给打电话。第一次电话，一级接线员断
然拒绝不给读cis的决定信；第二次电话，一级接线员继续拒绝，并且态度越来越差，

发帖数: 1634 | 24 如果是因为没收到RFE材料的据信REOPEN的话，需要在30天之内申请REOPEN，时间好像
是3个月，这个是在网上看到有人说的，不确定。
我也收到据信了，也是因为没收到RFE材料，信上说可以RE-OPEN。因为33天的期限，律
师给按寄出的时间算的（邮局的邮戳），移民官按收到的时间算。律师很怒，打电话跟
移民官争论了一番，可能接电话的移民官上报SUPERVISOR，过了几天，网上又给改了，
从DECISON的状态倒退着恢复成收到RFE的状态。
再给他们电话确认，说是据信不算了，按网上状态为准。律师说肯定是SUPERVISOR看他
们犯了错，就给改回来了。LZ不知道是不是也是类似我这么倒霉的情况，如果是的话，
赶紧给移民局打电话，以寄出RFE的邮戳为准，只要上面的日期没超出他们要求的33天
，就可以让他们改正。
这里也以自己的教训为例，各位收到RFE，NOID的XDJMS，保险起见还是尽早寄出回答，
免得他们搞错，给DENIAL了。不过，估计我这样倒霉情况也比较少见，还是告诉大家一
声，小心点为好。 |

immigration attorneys. It is almost like a white elephant myth. Since the
same BCIS officer that denied the petition in the first place adjudicates
the motion, attorneys face low success rates in these motions. The review
