Hi, good question: I discussed this question with another attorney here and
if your I-485 (Adjustment) was denied, and your husband are still in valid H
-1B status, you would still be in H-4 status but still ineligible to work.
It is unlikely that you will be denied, but we do have to worry about your
getting your Visa Screen within the next 6 m |

为有了offer letter，在12月5号让学校的international center办的加急（NSC）。估
计要2－4星期才能办下来。
因为现在有时间（刚毕业又没开始工作），所以想回国一次。先去本版精华区扫盲，结
果发现pending回国没有EAD卡的话就回不了美国了（视为自动弃权）。再问学校的DSO
，却发现这样做是可以的，只要我返回美国的时候，OPT声请还没有被approve。在ICE
的网站上就明确说明如下：

F1 visa to reenter US.
If you use H4 to return during COS pending, and even if your COS is approved
with F1 I-94, USCIS officer in your future application will determine that
you were never in valid F1 status because you reentered with H4.
So if you will change to F1, don't need to file in US. Just bring I-20 back
to China and get F1 visa stamp. You can reenter US one month before school

months in China, so we had to extended his stay. This happened in IAD.
But my friend's parents got six-month stay when they tried to reenter US
with only 3 days left before visa expiration. This happened at JFK.
I picked up all of them.

Some people just return to US using their I-94 to wait, although it is not
allowed. But it's not practical to wait in Canada for 1 month, that's why
US consulate give you back passport/I-94 or US boarder CBP rarely stop you.
Just remember to use visa stamp to reenter again before you want to file I-
485. AOS can forgive this previous violation if you reenter with visa stamp

The only exception would be for:

It depends on whether this "不慎F-1身份失效了" got entered into SEVIS by 大
学A or 学院B ? If no, it is quite safe to use the unexpired visa stamp to
reenter.
If there is bad SEVIS info, especially a fatal one such as unauthorized work
, the visa stamp is supposedly canceled. The legal way is to get a new F1
stamp at US consulate to reenter. |

laid off); I later went to School B for one year (went to CA and reenterred
with visa for A, no problem). I am going to transfer to school C (Polytach
at NYU) starting fall 2010.
Hope to use visa for A (valid till Nov 2010) to go back China and return US.
It was OK when I crossing CA border. Any PPL here know if it is OK at EWR?

If your OPT has been approved and you depart before you get a job, your OPT
ends and you cannot reenter unless you have a written job offer.
