个录像机，万一没有留下证据100％地支持自己描述的场景，自己就有罪了？到目前位
置在法庭上出示的所有的证据，都不与GZ所说的矛盾，这就够了。
在刑事法律上，必须由prosecutor证明GZ有罪。prosecutor不仅未能证明GZ有罪，相反
，prosecutor根本不能找出一丝半点与GZ的版本矛盾的地方。按照GZ描述的场景，self

发帖数: 1534 | 45 事情发生在德州，前些日子早晨开高速60迈被警察拦下，说超速，限速55迈，给了
ticket。我说限速就是60啊，他坚持说是55，是working zone。。。于是我只好说我不
知道。求情说第一次可不可以给warning，警察不同意，说是working zone。于是
ticket上写了60/55，罚的钱倒没有double，143刀。因为经常走这条高速，很确定限速
是60，所以想dismiss。后来去这条高速拍照，准备上庭用。限速牌就在working zone
牌子的旁边，就是60迈，所以明显我没有超速。现在的问题是我当时选的是先跟
prosecutor谈，现在收到法庭的信说在跟prosecutor谈的时候ticket是不能dismiss掉
的。如果不同意procecutor提供的offer，还要再去法庭trial。我这种情况是不是可以
直接上庭了呢？还有必要跟prosecutor谈吗？因为我也不想还跑两次法庭。谢谢。 |

你建议我去和条子讨论什么的，但是那他不就知道了比如有树叶挡着红绿灯，下坡什么
的情况么。我上庭如果去argue的话，我的point不就是说他判断我应该停车是under
normal road conditions，而我有特殊情况。他不就可以说我把特殊情况考虑进去了。
上庭我可以说你当时判断我应该停有没有其他consideration。他必然答不出我想的那
两个，然后我就可以说他的judgement没有考虑客观情况所以是不合理的。
-----聊天，问，再问，再问，关键是让他lost patience, 说不该说的话，这帮孙子，
你多问几句就会不耐烦的。只要他态度不好，你就可以按我前面说的办了。
但是如果他知道我的argument，他不可以说他把这些也考虑进去了么？
----magistrate根本不听具体的，说了也是白说。条子也不会提，他说啥前面我已说了，

发帖数: 2374 | 47 你的ticket是警察给你的，所以你不能躲掉，一定要和法庭联系吧。
一般先要见prosecutor，你和他谈一谈，看看能不能waive掉。
如果不同意，你就得见法官。这种case八成prosecutor肯定会给你各种condition。
你就多强调你的历史清白，从不犯错。记住绝对不要承认你错了。因为你和prosecutor
说的话都可以成为法庭的证据。
去见法官又有各种condition，不如警察没来啊，警察日期写错了啊，ticket信息不对
啊之类的。赫赫你还是有机会。你得自己找找。
不过话说回来，这样弄还是挺费时间的。除非你自己想要体验一下美国的法律体系。不
然你就自己斟酌怎么办了。
回到你的case，当然注意遵守交规还是很重要的。赫赫

发帖数: 60 | 49 在一个路口右拐，刚拐过去，在我拐弯的那个角上窜出来一辆警车叫我停车，下来一个
年轻白人警察说我红灯面前右拐没有stop就直接右拐了，我说当时是绿灯，他说他看见
的和我不一样，警察回到车里，2分钟后回来二话不说就给了我张罚单，临走时还撂下
一句话说他刚查看过录像，当时肯定是红灯。我本来想认栽了，他最后一句话提醒了我
，既然有录像我肯定上庭了，警察明显是撒谎，而且有点威胁我的意思，那我必须上庭
。LP曾劝我算了，为这点小钱不值得浪费时间，我说不是，第一我实在气不过，第二不
能让警察觉得咱好欺负，必须上庭。
第一次去prosecutor说给我减罚款，我要求看录像，他说今天还不能看录像。第二次再
去一看到录像prosecutor马上就说你没有任何错误，给我dismiss掉，我当时火冒三丈
，说这个警察明显在撒谎，如果他当时看了录像只要不是白痴就不可能开罚单，我说这
个警察有故意倾向，浪费我的时间，你的时间，和纳税人的钱，prosecutor说任何人都
会犯错。后来我也没再多说就回来了。
这个警察实在太变态了，不知道美国的法律对警察乱开罚单有没有约束条款？ |
