前段时间一直在关心学校的H1b能不能transfer到工业界，答案是不行，这样对很多人
来说，就会出现gap
结果进一步研究，发现cap exempt的H1b只要没有过期，是可以"port"到cap subject的
职位，用来渡过可能出现的gap的。
这对想从学术界转到工业界的同学们是一个非常好的消息，当你在四月份申请新的cap
subject H1b时，如果你的cap exempt的有效期能到10月1号，你就没有gap的问题。
当然现在还有很多律师不太清楚这一点，因为这个曾经有争议，我手头有uscis的一封信可以做为证据。 |

我的基本情况是今年3月离开给我办绿卡的公司A，4月底开始在新公司B上班，在A公司
用的是H1b，在B公司用的是EAD。
现在F家律师说要给我办一个loose H-1B，这样一旦485有任何问题被deny的话，我还有
一个H-1B，可以继续工作。他们说因为我启用EAD，所以要申请的H-1B是新的H-1B，如
果被批准的话，必须要在下次international travel的时候申请一个H-1B的签证才可以
被激活，而并不是一个H-1B transfer 或者extension。他们还说如果PD current 的话
，H-1B只能一年一年的延期，而不是三年三年的延。有人遇到过我这样的情况吗？
另外，我在A公司的最后一天和在B公司开始的第一天之间有1个月左右的时间是没有在
任何payroll上的，这个在申请H-1B的时候会有问题吗？
F家还说要给我办一个AC21，port 485 case to B公司，据说就是给移民局写一封信，

Your new job is based on the H1-B.
One company can sponsor your green card before you even work for them. In
your case, as long as you have not used your EAD and still on H-1B. Your new
employer has nothing to do with your 485 application.
If you used your EAD in your new employer, then you have to porting, because
your work is based on EAD and you changed your employer. Your are the
beneficiary of AC21. |

发帖数: 161 | 48 Memorial day想带父母去Olympic NP玩两天。看过精华区的帖子，父母身体不是很好，
不敢野营，也不想住cabin。能不能就住在port angeles,然后每天开车去玩，晚上回来
。现在想玩的景点大概有hurrican ridge, lake crescent, sol duc, Hoh rain
forest, kalaloch beach.
用google map查了一下，从port angeles到kalaloch也就2个小时不到，不算很远。有
经验的筒子们能不能指教一下？

我准备早上早一点从seattle出发，大概中午到Port angeles。下午就去hurrican
ridge, lake crescent，然后去sol duc泡个温泉:) 晚上住在port angeles。
第二天开到Forks,上午去kalaloch，下午去Hoh rain forest, 晚上在Forks住一晚，第
三天开回seattle。
这样应该合理一些吧？ |
