INDICTMENT,不用太担心。但是填485的时候一定要填有，然后单独写个STATEMENT,把所

，都是以charged crime来对待，也就是有罪假定。很狗屎，很歧视，但是没办法。
在visa interview或绿卡申请时，必须如实填写“Have you EVER been arrested／
convicted a crime的回答“YES”。如不如实填写，签证或绿卡铁定被deny，不要心存
任何幻想。移民局对撒谎的容忍度为零，无须任何其他理由。
至于petty offense exemption，前面有人提到。“你朋友”的案例，其实很轻，带上
规定的材料，如实回答签证／移民官的问题，不会因为这件事情本身被拒，否则他们就
违法了。 |

不过是故意用这个话题玩政治。两个党表面上口头表示非常支持STEM 绿卡，但是都故
意在自己的法案里面特意加上对方绝对不能接受的条款，本来他们可以达成一定的妥协
，比如砍掉一半的DV绿卡，加上一半的STEM 绿卡，本来法案也可以以简单多数通过，
但是都不这样做，故意要三分之二通过就是要给对方来个下不来台。好让对方成为被指
责的对象。

金安平是搞中国历史的台湾美籍教授；大家更熟悉的是她为张家四位才女（元和、允
和、兆和、充和）写的传记《合肥四姐妹》——说来耶鲁几位女教授都拿百岁高龄的同
事张充和做文章，除了金安平写传，孙康宜录其昆曲生涯，作《曲人鸿爪》；编其
书法，作《古色今香》。
以前在讲座上见过金安平，最有特色的是她眯成一条缝的眼睛，似乎永远也睁不开。这
学期开学，试听了她的左传史记、儒家传统两门课，印象刷地一变。她虽然眼睛和声音
都不大，但一开口便流露出对专业的强烈的热爱与信心。她用英语主讲，引用四书五经
时则中英文并举。原文背得既熟，翻译又准确而不带半点模糊；且中英文切换之际没有
丝毫思考余地，脱口而出，显然双语文字了然于心。学生问孔子自己是否用过“儒”，
她说这是个好问题——她很注意鼓励学生——一边回忆孔子说“君子”多，几乎不用“

没有Federal charge。[1]
法律条文参看NJSA 2C:18-3b，属于petty disorderly persons offense。[2]
一般的判决是$500以内的罚款，30天以内的jail，而且无犯罪记录的一般不会坐牢。[3]
对于闯机场的，其他一些州相关判例从罚款$25加community service到罚款500加坐五个
周末的牢不等，注意，是周末，不是五周。[4]
所以，喊着严惩的同学们，歇歇吧，不顾同胞感情就罢了，法律在这摆着。
自卑自省或者刨究中国人特点的同学们也歇歇吧，这事不是咱小江独创，没必要这么紧
