途写的，应该和大家商量商量。
我想下一步一个可能很有用的办法是有英语好的公民给议员和记者写信。
信里我想到两个point:
1. 大量H1B给予了不具有相应资格的人。例如去年Infosys提交了6万petition，拿到了
6000，也就是十分之一。而其他主张取消H1B cap的科技巨头的总和都没有Infosys一家
多。而Infosys等ICC对相应的research/industry conference，专利的贡献为0，或不
及其他本土科技公司的零头。这样的低质量的H1B影响到美国未来的创新和可能冲击当
地的就业。
2. 从redbus上的讨论看，有一部分人提交了三份甚至25分petition，其中到底有多少
qualified的人，是否违规自费申请或者有中介存在虚构职位进行欺诈是需要进一步研
究的。从这些consulting company的流程：培训－>上岗－>上缴薪水来看，是否有违法
上的问题。
要注意的是千万不要针对某个国家的人或者某个公司。如果没有准确的证据尽量谨慎的

看到版上有H1B petition 可以 trigger J1 waiver的说法，想问问怎么是实现的？J1
waiver和H1B是不同的USCIS部门在负责还是一起的？
DOS 2/19 寄出 FR，USCIS 显示3/4收到，我在3/11已经收到I-797C,但是I612目前还在
vermont center pending， 我应该催催了吗？

现在准备申请今年四月的H1B，有change of status和Consular Petition两种选项。看
起来change of status的申请我不需要离开美国，方便一些。但是公司的律师和我说如
果在提交H1B申请的时候J1的豁免没有办下来，只能帮我提交Consular Petition的申请。
找了一下版上之前的记录，没见有人说过这个问题。大家在申请的时候遇到过这个问题

我刚毕业，打算带家人去坐个Caribbean的游轮，就Carnival那种，visit US adjacent
islands。我有工作offer，大概5月入职，律师刚刚帮我file H1B petition。不知道
在这种情况下，坐cruise会不会有问题？
Concern是这样的(according to my 律师)。假设我H1B抽中了，如果我一直在境内，那
我的状态是change of status(也就是F1自动变成H1B)；但如果我在4月1日之后出境，
律师说我就不是change of status了，会变成consular notify，意味着我必须去使馆
签证来激活我的H1B status.
但是后来我又跟律师说，我其实只是坐个游轮，并不是回中国一类的。她回复我说: it

律师当初写的H1B petition，发现那个律师根本是根据我当年找工作时候的resume写的
。两页纸上敏感词大概得有100个，什么laser, high frequency, high power, novel
material, air force, ladar.........
算了,听天由命吧.

问道是否 file a immigrant petition 的时候， 选了yes, 然后把PERM的申请说了。
后来问了公司的律师， 她说PERM不算immigrant petition, 但是我这样填也不会有问
题， 因为 H1B can hold both immigrant and non-immigrant intent.

目，至今已经过去六年了，我在J1结束一年半以后用F1来美国读研究生，加上寒暑假回
国的时间，实际上已经在国内呆够两年。但是我目前唯一的证据，就只有护照上的出入
境stamps，寒暑假回国因为不租房不用银行卡，很难证明我当时一定在国内。所以我非
常担心仅有这个证据不足以证明我满足了两年回国的要求而无法获得H1b签证。所以我
跟公司的移民律师商量，想同时申请J1豁免。但是律师（Fragomen）跟我说，如果我同
时申请J1豁免会undercut我已经满足两年要求的argument，所以不建议我这样做。但我
仍然十分担心。现在的问题是，在明年4月1号之前，很有可能我是拿不到最终的J1
waiver approval，而有可能DOS已经把FR发给USCIS。那么，就很有可能出现的情况是
，USCIS同时会看到我的J1豁免申请和H1b petition中已经满足两年回国要求的证据，
请问这样的情况会给我的h1b petition造成什么不利影响吗？谢谢大家！ |

把推荐信都搞齐了。正在写petition letter。看了别人的范本，有点疑惑：EB1B是
petition on behalf of the institute, 有律师代办的话，对受益人(beneficiary)信
中口吻都是第三人称，比如说“Dr.xxx"如何如何。可我自己写这封信的话，该怎么称
呼自己呢？还是说on behalf of the institute, Dr.xxx is preparing this letter
by himeself。。。然后到处用第三人称？还是说 on behalf of the institute, I am
preparing this letter by myself...然后到处是I如何如何？
