是有人误会是潘老师要挟我们。这里我可以做个声明，作为成年人，我们能对自己的行

好签证的护照。
在另一个帖子里面已经说了，预约时选择外国人居住在加拿大，申请美国签证，所有美
国驻加拿大的consular post都有下一周的空位可选。
背包可寄存在领事馆街对面办公楼下的cafe，5加币。
面试时在室外第一次检查材料齐全性（对H1B来说就是护照，DS-160确认页，797原件或
复印件和照片），并在护照背后贴条码贴纸，然后上2楼，安检，在1或2号窗口再次检
查材料齐全性，并验证在加身份。我是新登陆的永久居民，只有登陆纸，枫叶卡还没有
收到，对方接受我是加拿大永久居民也没有碰到问题。这一步工作人员会在电脑里输入
一些东西，并在条码贴纸上手写在加身份。我的贴纸上被写了LI（应该是landed
immigrant的缩写）和加拿大登陆日期，以及另一个号码，大概是他们领事馆内部的签
证申请编号。接着在同一个大厅另一边的一个窗口按10指指纹。
排队时看到前面有一个亚裔拿的是加拿大护照，不是太明白拿加拿大护照的在那里凑什
么热闹，谁知道的来说明一下？

还有"Contingent upon the U.S. Citizenship and Immigration Services’

the position...."还有在工作描述中，"In his position, Dr.XX will be

感觉律师的写法很奇怪，我现在就处在这个职位上，为什么要用将来的状态，看起来好

我在前个帖子中提到了我的经历。很多同学写信问我推荐信的长度等等。很抱歉，因为
我也有很多借鉴或抄袭我的朋友们的推荐信和petition letter，我就不能跟大家分享
文件了。就说说我的想法吧。
我的推荐信相对较短，有四封是2页，有一封是3页。petition letter也就是我的cover
letter，是一般书信的格式，在最后附了我补充材料的清单，总共8页。
找好推荐人。一开始多找一些，万一RFE，还可以用上。
先把你想要在petition letter中陈述的事实材料等列个提纲。
首先，介绍一下你的补充材料有哪些。交待一下你请的为你佐证的人是些谁。
接下来，就可以谈谈你的学位背景和学术成就。证明材料首先是你的简历。学术背景无
非是毕业证什么的。学术成就，就是奖项文章等等。请把你所有的文章的摘要复印一份
。至于citation， 牛的人就不用说了。像我一样不牛的同学，或有中文文章又想查引
用的，可以用google scholars，然后把你的名字highlight起来。
然后，你要谈谈你做的东西跟国家利益息息相关。因为你毕竟不是大拿，（你要是大拿

letterhead打印. 然后他写了一封petition letter，是用律师事务所的letterhead写
的，以律师的口吻阐述。Petition letter 20 pages，包括enclosed材料的list,然后
就是summarize the evidence of my contribution。一共阐述了4点，基本每一点都是
通过大段引用推荐人的话来阐述的。这样组织好吗？我怎默觉得就是把9封推荐信拆开
了，然后换一种方式又攒在一起阿？大家的petition letter是这样的吗？而且为什莫
是以律师的口吻来说阿。

1. 大段的引用推荐信的文字（有接近或超过十行）合适吗？主要是因为推荐信里面有
一些内容可以作为硬证据来用（有实际可以证明的数据），所以就一起引用了，但是我
看一些petition letter模版中很少有这样大段的引用，我该如何处理这个问题呢？是
这样大段引用好，还是把其中的硬证据摘出来，然后只引用其中一部分比较好呢？
2. petition letter的格式上，是像写篇论述文一样比较好，还是列出清楚层次的1,2,
3点来比较好呢？总觉得前种格式重点和条例不够突出，不知道大家有什么看法？特别

发帖数: 3862 | 40 说 IO都有PHD,也太没根据了，他们的专业著作RFE letter，只是一个通用模板，适用
于所有情况,IO也就根据具体案例，在适用的条目下加点批注而已， 不用大惊小怪。
但是说他们是没见过世面的高中生，也是不负责任的说话。他们也许不懂专业术语，也
不可能懂得eb1申请中各种不同的专业，但他们肯定都是受过USCIS培训的，熟知USCIS
和法律的条款的，对于各种申请的要求到了抠字眼的程度。不管你自己认为你的水平如
何，你提供的材料一定要足以让他们信服你已经达到USCIS要求的水平。
而且USCIS要求burden of proof取证的责任在申请人，而不在IO, 而且要求的只是可以
相信的证据，而不需要像刑事案件里那样严格的证据，所以提供有足够可信度的证据和
逻辑清楚没有漏洞紧扣要求的petition letter,非常重要。而且我认为其实证据相对
petition letter更加重要，因为对于IO来说，他的任务是对你提供的证据作出他的判
断，所以证据的组织和呈现相当重要，在这个意义上，petition letter起到一个帮助

公司请的律师,petition letter从7月开始写，昨天终于给我看了一下
我觉得不能用
我自己的条件如下：
1. US 一般学校 Ph.D in ECE
2. 20篇publications, 其中中文2篇， 其余18篇为英文（含12篇一作）
3. 英文book chapter 1章
4. 引用107 (业内平均应用 5～6), 80%以上为一作引用。
5。review: 4篇杂志manuscripts; 18 篇国际会议 submissions.
6. 4个国际会议committee member.
如此条件，我想就claim "contribution" 和 "authorship" 两条，每条多点evidence
弄强一点
结果她给我足足claim了四条，每条读起来都觉得weak，need more evidence
不是没有跟这位律师沟通过，可是她每次都直接忽略我的requests,有两次还用教训地
口气说他们有自己的一套，意思是我不该管那么多
请问大家，是不是律师都这样，客户的concern/要求都不理，他们想怎么写就怎么写？

petition letter上好几段介绍申请人的工作领域的部分，完全从几封推荐信里copy来
的，但是也没有引用说来自哪个exhibit，这样看起来感觉和推荐信是重复的。。。不
知道大家都是这样写的吗？还是律师没有用心写好？
另外，之前照着律师给的exhibit sample，准备了一些资料，包括citation里的一些

发帖数: 121 | 49 上月底自己DIY的EB1A I140 approved， 从准备到正式通过花了大约3-4月时间。2012
年的时候，由于当时H1B忙上就要到期，就在mit 上急急忙忙的找了个帮写推荐信的律
师先办niw。这样做的好处是他能一步一步的督促自己赶快准备材料，不过坏处是他写
的推荐信实在就是从文章上copy下来，大多数还是要自己修改，也费了自己不少力气。
到今年review也攒了18个，外加有篇挺有用的文章发表，就想把EB1A递上去，结果一问
原来的律师，由于niw 140 已经批了， 他不能按照原来说好的再加1000刀办EB1A。想
想大部分材料自己都有，只要重写推荐信，就决定自己搞。
在准备EB1A期间，个人觉得最难的就是写推荐信和petition letter。自己在准备推荐
信的时候，打印下来很多和自己方向相近的模板，认真读了之后按照他们的逻辑忘自己
头上套。其实自己感觉写的并不是很满意 （没有那种读了之后脸红的感觉），不过由
于时间紧（大约2-3天一封的速度），还是赶紧发给了推荐人。另外就是准备petition

年的时候，由于当时H1B忙上就要到期，就在mit 上急急忙忙的找了个帮写推荐信的律
师先办niw。这样做的好处是他能一步一步的督促自己赶快准备材料，不过坏处是他写
的推荐信实在就是从文章上copy下来，大多数还是要自己修改，也费了自己不少力气。
到今年review也攒了18个，外加有篇挺有用的文章发表，就想把EB1A递上去，结果一问
原来的律师，由于niw 140 已经批了， 他不能按照原来说好的再加1000刀办EB1A。想
想大部分材料自己都有，只要重写推荐信，就决定自己搞。
在准备EB1A期间，个人觉得最难的就是写推荐信和petition letter。自己在准备推荐
信的时候，打印下来很多和自己方向相近的模板，认真读了之后按照他们的逻辑忘自己
头上套。其实自己感觉写的并不是很满意 （没有那种读了之后脸红的感觉），不过由
于时间紧（大约2-3天一封的速度），还是赶紧发给了推荐人。另外就是准备petition
