到下一份工作之前能够合法居留在美国，我们就需要转换成其它身份，F-1就是一个常
见的选择。
松，基本上没有被拒的可能。但是近年来，随着美国经济形势的恶化，移民局的执行标
准也越来越严，本人就不幸成为GAP的牺牲品。
就有不同的解释与错误的观念。例如有人是H-1B但是2月1日就被公司解聘，在之前就申
请到一个学校拿到I-20，但是开学日期是9月1日。在以前往往只要在2月1日之前提出了
I-539的申请，虽然是 9月1日才开:
grace period。这个日期不是你的解雇日期，也不是你最后一份工资单的结束日期。所
以，理论上，如果公司在解雇你之后，并没有立即到移民局撤销你的H-1B，你的身份就
仍然合法。我的情况就是公司的律师
三十天。所以，即使你在原合法身份过期之前提交转F-1的申请，如果原合法身份过期
之日距离开学时间超过三十天，移民局仍然会以“GAP太长”拒绝你的申请。我当时找
的学校，最早的学期就是秋季入学，:
，你的原身份仍然有效，并且你配偶的F-1身份或者H-1B身份也有效，移民局就不会拒
绝你转换身份的申请。

expire very soon. So, I just e-mailed and faxed my Expedite Requst to NSC,
my online status changed from Initial Review into Card Production on the 3RD

is very weak for EB1a.

不足1年的批量，如你。有人认为不足半年（485处理大约半年，所以需提前半年建库）
，甚至一个月的批量（真正的临时抱佛脚啊）

我话没说清楚， 我的意思是目前的排期是09 Jan， 因为目前是真排期， 所以我只算
09 Jan后面的pending， 根据13年10月的数据， pending 485一共3500左右。 每个月
如果处理200，到今年十月就又少了2000多，还剩1000多pending 485. 那个时候就该放
水了。 |
