good evening.
I am looking for a aprtment around san jose down.
today, i took a look a apartment (2br, $960/mon).
the owner of that apartment told me that if I pay cash, he can reduce the rent
fee a little.
he try to avoid tax? right?
cash is safe?
how much I can ask him to reduce the rent fee?

并非完全是为了省钱,主要是省时省事,因为我们看房子一年多了,清楚如何查找房子
的资料以及地区情况,甚至怎么看房子。很多房子我估的价格跟它们最后的成交价相差
无多。所以在这个前提下,我们基本上不需要buyer agent to help us to look for
the house。
我用过好几个buyer agent,最好的一个用了挺长一段时间,他为人很耐心,可是谈到出
价并不是很aggressive,而且很少帮我们探听到什么消息。(我也知道很难要求BUYER
AGENT to be perfect)
直接跟seller agent打交道的好处是,他希望你买,因为他的提成高,所以他会给你内
幕消息,及时跟你更新情况。我买的这个房子,砍了不少价格,得益于此。
好区,2007年初owner自己卖,要价$475k,收到最高offer$450k,owner要$460k,因邻
居一模一样的一周前卖了$465k,没成;
到下半年,收到$400k,心灰地撤出了market;
今年年初雇经纪上市$379k,无果,遂降至$359k,我们出价$300k,之所以敢砍这么狠是
因为经纪透露有地产开发商出$

从OWNER手里直接买房会不会便宜一点?
我从CAIGSLIST上,看到这个OWNER,她已经找了AGENT, SHORT SALE的。如果我和她自
己办手续直接跟银行接触买房,我会不会付的钱会少一点?就是说,会不会比通过
REALTOR和AGENT买,我付的会少一点?因为省了给AGENT和REALTOR的钱。

may cost $3000. We don't want to buy it, but have to buy the lender's title

上有angent,但自己又声称还是sell by owner,感觉有点怪。

刚signed了一个房子的contract, loan agent说在michigan, owner title insurance
是由 seller付的, phurchaser 不用管, 这对吗?有点纠结自己要不要买owner
title insurance.

On closing HUD-1, it has owner's title insurance $1200, half paid by seller.
Then it has an additional owner's title insurance base on ALTA 98, $180
dollars to cover encroachment, surface extraction, zoning, building permit,
etc.
I will pay $1200 for title insurance (actually $600 because seller pay half). The survey shows no encroachment on the property. Should I pay $180 more for the
additional title insurance?

初次买房,还请大家多赐教。之前请了个buyer agent,看了些房子,给其中一个出了
offer,出offer的时候也签了个雇佣buyer agent的合同,但那次的offer被拒了。现在
看上了一个sell by owner的房子,如果要买这个房子可以不用我们请的buyer agent么
?上次签的雇佣合同对这次出offer有影响么?还有,买sell by owner的房子,是不
是要请律师写合同,转title之类的啊?是买卖双方各自都要请律师么?还是只要一方
请律师就可以了呢?

候要多个几百块钱的什么fee。我所见的purchase case里都有owner's title
insurance,不过,价钱上相差很远,不知道是怎么算的。

lender's title insurance是一定要买的,据说在买房的时候买owner's title
insurance是为了之后ref方便,似乎一开始没有买个这个保险,ref的时候要多些银子
。一个title公司的人给我解释过,不过,我就记得这么多了。ref的时候不会有owner'
s title insurance的。
应该说是borrower出这些钱。我还没见过seller出的呢,除非seller答应给credit。不
过,一般seller只是在房屋需要修缮时才会答应给的。不管是什么原因,seller's
credit都不能超过closing cost。否则,不符合Fannie Mea的规定,贷款无法批出。

clean of liens and other unforseeable troubles.
You can ask your lender to give you a Good Faith Estimate (GFE), which
breaks down the closing cost. Here you can see whether you are paying it or
not. If you are not paying it yourself, one possibility is that you don't
have ensurance, and the other possibility is that the selling is paying for

没见过有seller付owner's title insurance的,都是buyer自己付的。
我的理解是,由于借钱给buyer,所以要求buyer 买 lender's title insurance以确保
lender对这个房子产权的拥有。而buyer自己买owner's title insurance是出于对自己
权益的保障。比如突然跳出个张三李四说这个房子其实是他的,拿个伪造的Deed来
claim产权等等。

我们是第一次买房子,所以找了一个朋友推荐的中国人agent. 这个agent家离我们这儿
有些远,开车1 .5小时,带着我们看了2次房子,总共7个小时,没看到很满意的房子。
最近我们自己看上了一个 sell by owner 的房子,打电话给agent,希望他能来看,没
来。我们就自己看了,回来后对房子很满意。考虑到我们是第一次买房子, agent来来
回回也不容易,保证给agent commission fee,希望下次他能来看看房子,然后帮我们
弄好合同。
跟owner谈价格之前,电话agent,希望他能够一起,他没有同意。回来后,希望agen准
备合同,告知我们预付 房价的2%或者$2000.我们觉得他没有看房子,只做做paper
work,希望付$1500。 没有同意,现在不理我们了。
我们做的是不是很不地道?可是他也没有跟我们一起看房啊?如果没有agent,我们能
搞定合同吗?需要注意些什么?

保险30-40%),这说明其实不买owner's title insurance而中招的概率是非常
非常小的.所以你也不必要太担心.

You don't have to buy the owner Title insurance. However, if you don't buy
it and there is a cloud in the title, the title insurance company will cover
only the lender's portion. The attorneys always buy the owner's title
Insurance to protect their clients.

马上要close了,记得原先contract上说seller给买owner's title insurance/policy,
今天拿到copy,title是Texas Commitment for Title Insurance,里面分schedule A
,B, C, D 四部分那种,基本上看不懂,就看到房子的价格和premium(1k出头)。立
刻问agent确认这个是不是title insurance,结果agent说那个只是title search,说
insurance要自己单独买。然后我去这个title insurance company 网站查insurance
for buyer,看到quote 和我拿到的copy 上的premium 一样,然后再问agent,她就说
她也不知道了。请问大家,这个到底是不是owner's title insurance? 谢谢!

谢谢你的建议。你说找朋友推荐real estate agent,又说要甩掉agent,这第一个real
estate agent 是指real state lawer么?哪里去找比较靠铺的呢?
分析已经作过了,心理有了个价格的底线,假设房子没有问题的说。所以我觉得
negotiation part我可以自己来和owner谈。。。就是怕有什么trick在里面,尤其
owner是印度人。。。
请问买这样的房子,有什么potential risks呢?

1。owner说他会写好paper work,我可以雇人来帮我看 (这个是不是需要律师来帮我看
呢?)
2。closing的时候会在第3方,owner说他也会找好,这个是不是我也需要带律师来呢?

Are these two insurance different? They are in the same place in the GFE
forms.
another question is, The origination charge is $65 for PenFed, while it is $

Have been waited about 5 month, and finally short sale got approved.
My agent called and said: The current owner's lender is Bank of America. I
have to pay about $3500 which is current owner owned HOA. My agent said she
tried her best to argue this for me, however, as she said, this is the rule
of Bank of America that they don't clear the HOA. Me as the buyer, needs to
pay this amount.
Feel bad.
Any one knows if do I have to pay this?

这是标准的做法。而且Escrow公司也会在最后交割时会按合同的要求来执行的。
2. “请问这样是正常的出入么?” - 因为先前给的是estimate,新的法律规定最后总
的title及其它服务费用不能超过原来估计的10%。不知你所说的情况超过了10%没有。

I asked this question to my agent. She said in her more than
20 years experience as a buyer/seller agent, she hasn't seen
anybody who didn't buy the owner title insurance.
Btw, we are in NJ where buyer pays the owner title insurance.

经过公证的遗嘱, AGREEMENT或抵押协议, 放在保险柜里, 而不是拿到LOCAL COURT去
record.这些东西, TITLE SEARCH也根本查不出来,等你买了房子一段时间, 万一人家把
这些文件拿出来, 上法庭一告, 你要是没有TITLE INSURANCE,就会很麻烦.

建议买一个,而且有的州是seller出这个费用.
Owner's title insurance主要是保护new owner的利益,可以确保产权方面意外事
故发生后的赔偿,包含了所有重新恢复拥有产权所需要的法律费用,有的时候, 有
些人会把经过公证的遗嘱, AGREEMENT或抵押协议, 放在保险柜里, 而不是拿到
LOCAL COURT去record.这些东西, TITLE SEARCH也根本查不出来,等你买了房子一
段时间, 万一人家把这些文件拿出来, 上法庭一告, 你要是没有TITLE INSURANCE,
就会很麻烦.

你的想法基本属于错误的。包括楼上某位,认为查了public record就会没有问题,这
个观点不对。
1. Public record不一定是完整的,一旦有人跳出来claim产权,evidence最重要;
2. 你只说到了current owner,谁能保证前任owner?builder?甚至是整个land的
eligibility,没有人能够保证哪一天不会跳出来一个人说这块地皮是他的,或者说牵
涉到其他的问题,比如说environmental的;
3. 没有买的,如果买房经手了律师,closing agent或者是escrow officer,他们看到
这种不买保险的,肯定先把免责的clause都写好了,出了问题,没有人可以分担,只能
自己解决;
建议最好是买,房子得用不少年,一两千块,绝对是买安心。

为什么broker给我的quote里面,lender's 的比owner's 的少?比如lender's 那个是
300多,owner's insurance却是1000多了。
