“各有各的定义”,其实很含糊。其中列出的5、6条可以采取的行动,大部分都是商量
和仲裁,只有最后一条是说可以上法院上诉;而随后又说这种诉讼额度太小,不是很可
行。就像我说的,实际操作上大家都是商量着搞。如果真有人神经兮兮去小额法庭,多
半会输,就算赢也没什么好处。
楼上有人也说了,这里面根本的问题就是无论是ordinance还是CC&R,对fence的
ownership都必须做一个明确的定义,谁出钱修的,就是谁的。在这个的基础上再来定
义“use”,再来判定费用的分担,这就很吃力。加上residential property本来的法
律法规就light,不同于商业地块,走法律程序是吃力不讨好。
就LZ的具体情况来说,如果邻居真的发疯要上法院,(那也要在他自己出钱把篱笆修好
以后),LZ可以有很多种办法去应对。比如要求对方提供ownership归属的书面证明,
提出对方修篱笆的费用不合理,说对方的篱笆修的不好看,影响自己后院的使用,反诉

自由。比如说噪音,city or county一般都会有对噪音控制的ordinance;如果你有

You are actually wrong about this. Just talked to several student legal
service advisers: the owners are ultimately responsible for snow removal in
New York State. However, this is a gray area of responsibility. Normally it
should be stated in the lease, if not then it's open to interpretation.
There are fines for not clearing the sidewalk in front of your property. $25
for first offense and $100 for second offense.

from doing business from your apartment, you should be able to do it.
Especially if you just register the business, it will be just merely a
mailing address. Highly suspect that your property manager doesn't know what
he/she is talking about. |
