有一幅数独游戏，恰好她非常喜欢这个游戏，便顺手玩了起来，
没想到的是，那就是一部价值8万欧元（约合人民币59万）的艺术品。事件发生后，博
物馆报警。
据外媒报道，原来，那是艺术家Arthur Kopcke的作品《Reading work piece》。老妇
人表示，她看到作品上有着格子和提示语句，一旁还写着“填入文字”，因此拿起圆珠
笔把整个游戏完成了。
对此，馆方回应，他们明白老妇人并非出于恶意，不过还是要依程序诉讼，以便申请保
险理赔。
值得庆幸的是，老妇人并没有造成永久性的损害，预计花费数百欧元就能将上面的字迹
清除，费用则由馆方承担。 |

但是故事没有完，既然音乐名'Variations on the Kanon by Pachelbel'，也就是
说，这是乔治温斯顿改编Pachelbel（帕卡贝尔）的Canon(卡农)。
什么是卡农？其原意为“规则”。指的是复调音乐的一种写作技法。其特点是各个
声部有规则地互相模仿，也就是后面的声部按一定的时间距离依次模仿前一声部的旋律
。用卡农手法写成的乐曲就叫作“卡农曲”。我们熟悉的轮唱曲就是卡农曲的一种。卡
农出现于十三、十四世纪。后人常采用古代曲调作为卡农主题。如巴赫的《五首卡农变
奏曲》。十九世纪的交响曲、奏鸣曲也常用卡农手法，如贝多芬的《命运交响曲》。

在IMDB给《The Reader》打分时，
网站推荐了《Judgment at Nuremberg 》
看完后，喜爱它甚于《12 Angry Men》
因为前者是基于事实，相当于纪录片，
对程序正义的恪守，不停地逼近真相，
不剥夺弱者的申辩权利（此时他们是受审的嫌犯），
强者坚信宽容的价值（此时他们是胜利国的法官）；
这留给了德国人一个服气的审判，大家才能重新开始。
这些原则，人们往往认为在现实世界不可能存在，
只是理想主义者骗人的鬼话。
如果我是家长，在他成年之前，会建议孩子看完《纽伦堡审判》与《十二愤青》
如果我是老师，我会不停地跟学生讨论这两部电影，
他们最终会知道，只有理想主义，才能让不甚理想的现实趋向于理想。
也许东亚的某个国家，将来也要迎接自己的最关键审判
在那个时候，他们有没有能力向历史交待出自己的纽伦堡审判？ |

发帖数: 170 | 26 纽伦堡审判讲的二战后在纽伦堡（曾经的纳粹政府重要城市）审判德军要犯。美国在当
时的形势下需要德军支持，很多判决不重。但是电影里判了全部被告（4个）无期。还
涉及了serve the country和 serve the international laws 的关系。
不知者无罪，具体实行的时候可能还要看是不是应该知道，在涉及millions of lives
的时候可能又不一样。

，和对敌国平民的奴役和虐杀。这两类案件，都归入第四类罪行：反人道罪(crime
against humanity)。老萨好像也因为这个罪名被绞死的。
四类罪（有时称为三类罪）（密谋破坏和平罪，破坏和平罪 -- 前两类有时合并为反和
平罪 --， 战争罪，反人类罪）中，前三类其实是政治罪，只有第四类是真正的刑事罪
，判罚也最严厉 -- 基本上，纽伦堡审判中的所有的死刑判决，必有反人类罪才能成立。
反人类罪的纲领文件之一是 Nuremberg Code，也是大家平时搞 research 时最经常遇
到的，尤其是在做人体试验时必须了解的。两个要点是：基本权利，自由意志（志愿原
则）。保障则是知情权。
我希望我的帖子分别说清，民主制度无论对内还是对外，都无法在理论上充分地，或者
在实践上有效地，制约这两类反人类罪的案件的发生。纽伦堡体系走的本身就是宪政的
套路。
原作者把纽伦堡审判和民主纠缠起来，不客气地讲，基本上可以说，不但对纽伦堡审判
的法理原则和实践基本无知，对民主也基本无知。 |
