，员工全责。而且不问青红皂白就开除。
这类policy细节不同，但大致方向都一样，在我看来都是非常有问题的。 |

发帖数: 3610 | 10 合同这个东西是这样，他拟定霸王条款的时候，也许心里也有点打鼓，感觉好像有点问
题，但是没有深究。况且员工属于弱势一方，一般都会签，所以也没人去挑战他的条款
。法律也就不会主动去管。
合同一旦签了，除非超级不公平，并且是现有法律能识别的不公平的类别之一，才会被
void，不然强势一方就吃定了弱势方，很难推翻重来了。
但总有人挑战感觉到不公平却又说不清的东西，把它说清，然后没准就成了，所有
landmark cases都是这样来的

发帖数: 3610 | 18 其实法理只是一方面，律师的三个利器:法理，法条，奇技淫巧。其中法条包括法律条
规，判决先例，各种程序法等。奇技淫巧包括故意让对方miss掉诉讼时效，或者找人做
伪证，找私家侦探窥探对方动向等。
我以前以为这三种是并行平等的，但后来经验越多，越觉得它们的关系有点像锤头剪子
布，是个环环相克的关系。
其中法理优于法条，因为法条是遵循判决先例，而法理是颠覆判决先例，推翻大家按一
贯的道德标准制定的原则，所以一旦以此制胜，可以创制新的判决先例。
法条又优于奇技淫巧，如果一个律师眼观六路，往往是可以邪不胜正，可以在正面交战
中打败对方搞的猫腻
但奇技淫巧往往又优于法理，当对方的伪证足够充分，比如说，让人相信了他们真收了
20块钱，并且是明知对方是间谍还带进去的，那我再讲法理就没有任何意义了。
所以在对抗的过程中，双方是不停猜拳的，而且拥有的时间是对等的，往往是在自己出
拳的同时看到对方的拳，再做反应，这是个非常惊险的过程。
所以一个好的律师团队，什么样的人都要有，包括坏人。因为只有坏人才对付得了坏人。 |

You are partially correct, and maybe differences of opinion are so minor
that they are moot, but I do continue to give Obama a little more credit. In
part I think that Obama has been trying to give out what he can in
piecemeal fashion to us in the GLBT community, possibly in priority order.
