（一）梁警官是极端自私之人，才导致陪审团成员无法原谅他
12个陪审团都一致认为梁警官有罪，那为何华人大都以为美国司法表现在梁警官身上就
是判决不公？言外之意有种族歧视的嫌疑？
撇开种族立场，单从心理学角度来看梁警官这个案子，我们就需要静心静气地反思这一
事件是什么因素导致12个陪审团一致认为梁警官有罪的共同心理。
我们需要做一个假设，假设梁警官是一个有教养的人，那就会出现下列一系列“如果”
。我们根据这些“如果”对12个陪审团的心理作用从而推导出结局应该是怎样的。
1.如果梁警官是一个善良的人，那当他得知他的子弹误伤了人（这是他和同胞们坚守的
案件定性），那他就应该不考虑自己的得失而立刻去对受伤者施救。
2.如果梁警官是一个能换位思考的人，那他就应该当即明白无辜被杀的人也有父母或妻
子儿女等亲人，人家的亲人被打死了，他就当即想到如果自己是对方，自己的父母兄弟
妻子儿女等亲人该是何等痛苦？

Voluntary manslaughter is an intentional killing that happened either
because of "adequate provocation" or in an unreasonable attempt at self-
defense.
A voluntary manslaughter conviction carries a sentence of 3 to 11 years in
prison. Involuntary manslaughter is an unintentional killing that happened
during the commission of a misdemeanor or because of gross negligence (

murder和voluntary manslaughter一般带有杀机 intent to kill
involuntary manslaughter一般不带有杀机
murder重点在于蓄意，蓄谋已久，willful, deliberate and premeditated action.
voluntary manslaughter是原来没有蓄谋，某种情况下临时起了杀心，比如被provoked
, mentally disturbed, and things happened so fast that he had no time to cool down.
