很多情形律师还是有用的。而且大家分的还特别细。做employment litigation的如果有personal injury的case也还是会找那些的大拿，不会自己从头做起。我之前在court见过pro se litigants, 我觉得大部分情形是不可行的。
当然，还是我说的那句话，职业移民，如果本身没有硬伤，法律的技术含量不足，自己愿意花时间花精力的，而且英文也不算差的，DIY非常可行。 |

如同医生一样，律师们在法学院是什么法都学的，从业之后也可以做general practice
的律师或者某个法的专业律师。Patent attorney属于比较专业的律师，就如同皮肤科
医生是比较专业的医生一样。
要成为patent attorney一般需要两个条件，第一你要是attorney，也就是说你要过
state bar，成为从业律师。一般来讲要有资格take state bar就要去上法学院获得JD
学位，当然有些州也允许LLM考bar。第二个条件是要register with USPTO，也就是说
要通过USPTO主持的patent bar考试，成为registered attorney。而要有资格take
patent bar就必须有science或者engineering的背景，对alien来说当然还要满足身份
条件。详细请查询USPTO OED。具备了这两个条件才能被称为patent attorney，所以这
也是为什么大家说patent attorney的barrier是比较高的，如果你既有技术背景又有律

1.你姑父和姑妈的婚姻存续期间,你姑父的总收入有30w吗? 10年也就是平均一年3万,也
不算很多. 如果有的话这笔钱完全就是community property, 按照加州family law, 你
姑父就算要处置他自己那部分的community property, 也不能处置你姑妈的15万.这种
情况最好办了,直接file motion to dismiss就完了.
2.假设不是community property, 而是婚前的personal property, 那你姑父也已经通
过实际行为把这笔钱赠送给你姑妈了. 对方要起诉你的话,civil suit谁起诉谁举证.
如果不是事实的话,你姑妈完全不用怕他们.
3.如果非走到上庭这一步,不幸的是律师并不好找. 打这种民事纠纷诉讼的律师十有八
九都是不靠谱的. 教你一些小tips辨别好的诉讼律师,跟对方聊聊对方的litigation
strategy是什么. 直接让你应诉的你就pass吧.能教你们怎么在change of venue,

屋有litigation issue，买主要求撤回合同，这个律师打电话给买主说对方律师要求
5000美元settle this issue。后来再一通电话说改为3500美元，最后发信说要求1000
到1500美元。
买主律师原email为：
The Seller’s attorney has contacted us again to ask what you would be
willing to offer to settle this matter. Are you willing to make a minimal
offer of $1,000 to $1,500 to do so?
最后，买主在合同中找出相关条款撤回合同，没有支付索要的1000到1500美元。
买主律师在购房过程中相当不给力，不做好本职工作，比如(a)不阅读合同条款中若
有litigation，买主可以依法退出。(b)向买主索要不必要的1000到1500美元，有联合

2，可能吗？除非是回家太晚，累得直接躺床上了。
3，看你在哪里工作了。
另外，patent prosecution 只是专利法里的一小块内容，大概也是最乏味的那块。不
幸的是好像还是最没油水的那块。patent litigation 才是大头。不过操作起来和普通
的litigation就没有什么大区别了，就连专业背景也是可有可无的要求了。 |

不过我倒是对楼主提供的经济咨询感兴趣。据我所知，很多公司找经济自选，比如nera
什么的，其实就是想要一个expert opinion，然后方便他们用这些数据、结论支持他们
和政府的lobby，或是在court中litigation，所以这就是几乎为什么每个major
economic consulting公司都有anti-trust，litigation这些部门。所以credential很
重要，刚毕业，或是还没毕业的经济博士要找到合适的项目很大程度上要靠运气。 |

了。国内的negotiation都是私下的，关系比什么都重要。国内做项目的思路是LS，一
次性赚足即可。如果用这边的思路来做项目，litigation是不是好的切入点？国内跟外
国公司litigation的项目有了解吗？这个不用担心不踢开。

when they are reluctant to tell.
all I said was Chinese not born in the US is not suitble for litigation. If
you enjoy working with people, there are a whole bunch of careers out there
other than practicing law.

not just from witnesses.
other than litigation, most lawyers dont deal with people at all. they do
exactly what you do in your cub: read the paper, and write down what they get.
If you can not do litigation, there is not much point practicing law since you
want both money and interpersonal communication, with the latter one lacking
for most lawyers.

those patents are probably routine patents for which not much research and
arguments need to be made.
Litigation is where the big money lies:) The trick is you usually win for the
prosecution but it is not so certain for litigation.

Loyola job fair, the upswing is inevitable. International IP litigation is
also growing fast.
But, firms are still being picky. Average tech background (e.g., BS in EE/CS)
does not go very far. MS degree, or patent-related work experience, are very
desirable. |

发帖数: 496 | 47 I talked with a few partners at local IP boutiques last week. Their feeling is
that if you want to do IP prosecution, then there are lots of opportunities
out there. But usually people are getting so bored at drafting patents ten
hours a day, so many, who work in IP field, do a mixed work load with both
litigation and prosecution. And sometimes it is not so well balanced due to
the nature of litigation and you'll get toast when doing both together.

So far I know Orrick and WSGR are hiring Chinese IP litigators -- there is a
big influx of litigation from China/Taiwan, and they simply don't have enough
people who has a tech/law/language combination.

the year last year.
Interviewed with them last summer. The two junior associates whom I met both
looked like sh*t. And I can tell they didn't like their job. Most likely
they didn't have chances to work on the mega cases, but were stuck in doc
review, or things of that tedious nature. One associate hinted that he was
going to leave the firm. Just did a search. He is not there anymore. |

发帖数: 32 | 50 不知道别人怎麽样啊，就说说我自己的情况吧。三四十名的学校，工科背景，英语跟广
大留学生比呢比上不足，比下有余（可能还偏下多一些），性格绝对算内向的，我不觉
得法学院非常难念，一周60小时绝对能很好成绩的读下来（如果你不是像我一样经常一
边看书一边上网的话）。这一两年市场非常好，我们学校的成绩中等偏上的一般都能找
到大所的工作。但是的确bio领域的IP如果没有PHD的话会比较难因为所有的candidates
都是PHD，你说employer会怎麽选。当然你打算做litigation的话学位就不是问题了，
但是litigation对于你的个人情况来说更不太现实。我建议呢就是找IP boutique一般
会让你什莫都做，你进去以后只要能证明你能写专利，学位就不再是什莫大问题了。
我非常同情你太太，希望她早日康复。我觉得你英语不是太差的活（如果第一次LSAT就
能上160，那简直是很好了），法学院一定是能读得下来的，工作也是一定能找到的（
如果市场不再crash一次的话），但是最大的问题时以后的工作。你得问问你太太以后 |
