说事没必要。 Apple至少与20多家公司打过官司；原告和被告都有的。 我最大的
Concern 是Apple以其巨大的财力，通过官司手段，在手机领域里消灭竞争和垄断市场
。通过封闭系统，在市场上绑架用户，不断地高利润的炸干用户的钱包。 HTC 官司后
几乎再也没有能力和APPLE 竞争。Nokia和Rimm 几乎已经垮台。唯有开源的 Android
阵营。 开源与封闭的斗争在我看来如同公益与自私，正义与邪恶的斗争。开源则是鼓
励中小企业，弱者参与竞争；封闭的 Apple 是把同行业的公司都挤垮，独食而肥；

求助各位大虾，在买房时，agent帮我们向一个lender提交了贷款申请，但是在提交2周
后lender告诉我们，他们查到我们要买的社区存在一个home owner association与
builder之间的官司，主要是关于屋顶维修的，lender考虑到这个官司,所以可能不会批
给我们贷款。
请问有没有版上的朋友遇到过这样的情况呢？我们觉得整个手续过程中agent没有提到
过或者查到过这个问题，到了申请交上去2周后才说，责任是不是应该算是他们的呢？
因为这时候再换lender又需要好几千块的申请费，还耽误closing的时间，所以请教大
侠们如何才是最好的解决办法,谢谢！

的，其他不管以前是文科还是理工科背景，毕业全部进大所做corporate了。很难吗？
还有作IP的，为什么大家一说就是给人申请专利呢？Patent prosecution那是IP里面入
门要求最低，最容易被outsource，profit margin最低的一个部分。IP里面除了patent
prosecution，其他的都不需要理科背景。可能有人说理科背景还是有帮助，好吧，对
于patent litigation可能有部分帮助，但是做patent litigation仍然完全不必须理科
背景，多的是以前学历史政治的人在做。而且IP除了专利，还包括trademark, trade
secrets, copyright等等。这些更是不要求什么理科背景了。如果是日常的soft IP
portfolio management，更多的是需要跟客户搞好关系，怎么作strategic planning。

patent law是Intellectual property law里的一支，不过基本上90%的IP work是有关

litigation的memo或者法院case的卷宗。一般的lender只是通过agent给的HOA
Questionnare来看看有没有litigation, 但是如果你的broker跟lender argue并提供上
述材料 and 这个litigation的内容在lender的容忍范围之内，lender会给您make
exception的。如果努力过后仍然不行，再walk away也不迟。

如果HOA是被告，或者litigation与房屋质量有关，估计就戏不大了。
如果litigation是其他理由的话，可以try Hudson City，ING，Emigrant等。如果
Hudson City要的话，rate也不算很差。
不过，LZ要做好心理准备，有litigation的condo很难找到贷款。另外，自己hold loan
的银行大多有prepayment penalty。 |

择，
所谓往food chain上层游动嘛。不过这样的话一定要争取去个litigation做的好的所，
而且要看那个所litigation和procecution部门之间的隔阂大不大，你有没有机会多和
litigation那边的人打交道。另外从低层做起(无论是tech specialist还是1st year
associate），还有很关键的时候就是所里和高层的partner的交流合作关系如何，他们
的mentor制度好不到等等。这些东西大的firm的review都可以在vault上查到，小的ip
boutique么，就看那里
有没有认识的人，口碑如何了。

来了，赶鸭子上架，硬分了一部份让我做。我当时做的是极其痛苦啊，根本看不明白那
些化学分析的图样和解释。 我handle的一般case就300-500页的case file. 这个
case有6个纸箱。。。。。还好后来那个case settle了。我就不明白那位说做IP
litigation不需要理工背景，而且还多的是学历史政治的人在做是哪里来的样本啊？国
内？那些人做的都什么IP litigation啊？trademark和copyright吧。如果是做patent
的，那做也有非常大的限制吧，没那个背景真的是做不来的啊。我当时脑子发热修了些
patent的drafting和litigation课程,简单的machinery我还ok,其他的基本跟天书一样，
最后只能drop,我这修课尚且如此，实际practice没相关专业背景他怎么操作的啊？ |

诉讼)的赔偿金给封顶！律师才是美国医疗贵的第一大原因。但是litigation lawyer是
美国两党（尤其是民主党）的支柱和金主，所以不会改变的。现在的美国政客谈到
medical cost, 都在dance around, 很少有人敢提到litigation。
你说的房产税里，怎么还包括社区大学的费用？seriously? 还提到换石板，减树枝？
那难道不是正常维护房屋所必须的费用？又不是政府收的。
生病看医生花钱，是没办法的，但房子是可以量力而行的，多少钱办多大的事，非要硬
撑的话，是个人的事了。
学费的话，这里K12是免费的，如果真穷的话，学校里的那顿午餐政府还可以廉价甚至
免费提供的。穷人家的孩子只要够优秀，好的（私立的）大学现在都是need based
financial aid, free ride的也很多。哈佛去年的行情是家庭收入低于18万的就
qualify了。我一个朋友的女儿刚进Dartmouth, 一年7万的学杂费，给减免到2万，比州
立大学的还要便宜。 |

我说找律师小心是有根据的。
曾经写好的东西给律师， 有个律师nurse出身直接就说他们review过全部材料， 西雅
图儿童医院没有任何责任， 根本不是case
这些律师是靠大医院医生发财的。 啥地方都有自己的门道， 就是地区大医院的医生控
制小医院和医生。 一般不敢接就算了， 不会胡说八道。但是有些没有品信的， 比如
蒙古大夫，什么都敢放。
你打官司告texas children， 在职的医生吓死也不敢给你作证。 而且会改诊断改证词
， 这都是律师告诉我的。
当年我们宝宝出事后，我们没有打官司的时候， sch的医生直接这么说， 谁也不想发
生， 就是钱的问题，我们可以出证词你起诉你的PCP. 我当时根本就不想这些， 说到
底是什么病， 救孩子最重要，不明白你说的是什么意思。。。
医生马上判断出我们没有专业人士帮助， 开始掩盖， 骗我们，杀人。 我们走到这一
步每次都是因为自己太认真，认认真真做事情， 按照logic.
而医生不一样， 他们按照procedure, 而且医生可以保护自己放任何屁， 最后杀人就
稀松平常了。

不受祝福的婚姻多了，suck it up！
至于同性和乱伦的关系，人家说的根本不是法律能不能修改成允许前者禁止后者。人家
说的是，反对限制同性婚姻的微薄理由同样适用于反对限制包括乱伦在内的许多异类“
婚姻”，这是法律范畴的问题，是个很严肃的问题，直接关系到这个问题应该用粗暴的
法律手段来解决，还是让社会自己去解决。
至今为止，未见哪怕一个自私的gay和其好心但********的支持者们说出为什么同性婚
姻不能限制，但乱伦能够限制。

到贷款了。
只能退出了，有些钱估计是拿不回来的了。有HOA的小区，很关键的一个问题就是有没
有litigation。如果HOA是被告，基本上100%拿不到loan，如果HOA是原告，还有救，但
是如果牵涉房屋质量，就回天乏术了。
如果当地有 Sovereign Bank, 可以去问一下，他们似乎有program针对无法warrant的
condo。不确知有没有针对LZ这种litigation的房子的贷款program。 |
