我是J2，无工作（无SSN，应该也没那个什么ITIN），10年2月份过来
的，中间回去过一个多月（4月份到5月份之间），之后就一直待在这
里，去年报税的时候，就把我算是NR，所以就没有多少退
税，那今年再报的话，我就算resident了吧？
因为我看519上说，只要去年在美国境内待满一整年（从Jan1 to
Dec31）就算是resident了，我应该算吧？（保险起见，想在这里请高人
帮我确认一下）

发帖数: 516 | 33 关于EB2/EB3的绿卡有基于perm的和NIW。PERM的一般程序是
PERM-〉I-140 - > I-485,PERM的申请日期是你的Priority Date (PD),在你的140通过
后，PD可以保留，即使以后重新申请绿卡都可以使用最早的PD，如果你的140没有被
revoke的话。你的140没有被revoke了，就得一切从头开始。绿卡名额都有的国家没有
限制，但是对中国和印度有，因为申请人太多了，所以要按照申请时间的顺序来。所以
如果你的PD在USCIS正在处理的PD以前，你可以交 I-485，这一天是你的request date
(RD)of "Adjustment of Status" (AOS). 通常RD三个月后可以拿到EAD，但是要最终拿
到绿卡还得等USCIS批到你的那个PD。通常USCIS批的PD是一个月一个月往前挪。我的PD
是DEc 10, 2013, 而现在USCIS批的PD是Jan1, 2012,那么我大概需要等两年了。
NIW的类似，他们是直接从交I-140开始，交I-140的那天是他们的PD。
建议你多到这里看看，这里还是有很多能人的。 |
