incitement to commit genocide就已经犯罪了，不需要种族灭绝已经出现，而且政府
与个人一样负责。不久前还有记者，电台工作者被国际法庭判这个罪，因为他们在雷旺
达种族屠杀之前进行过煽动。
美国既然自己已经签署了这个决议法案，就是已经认可它成为了美国自己的法律，因为
所有美国签署的国际条约都是美国法律。
也就是美国已经认为Direct and public incitement to commit genocide这种speech
不是free speech,而是一个罪行。
那如果美国现在要推翻我们这个案子说这是言论自由的话，岂不是与自己承认的国际条

合国大会在2011年已经通过关于言论自由决议，以下几种言论不属于freedom of
speech/expression：
Exceptional types of expression that States are required to prohibit under
international law
1. Child pornography

这个决议美国可没有保留条件不承认这条煽动种族屠杀的例外。既然自己承认了，就不
能现在又反言。如果对此有不同意见，那该去联合国理论。而我们就已经有了此案的法
律依据。

Child pornography
Perjury
Blackmail
Incitement to imminent lawless action
True threats
Solicitations to commit crimes
